The Idea Behind GPSR
The GPSR applies to all products available to consumers, whether sold offline or online. Its primary goal is to ensure these products are safe to use. To achieve this, product packaging must display specific information about the manufacturer, the product's origin, necessary certifications (such as CE markings), and liabilities in case of product failure. For online platforms, this information must also be accessible to customers prior to purchase.
In our case, this means that Amazon (as the platform owner) is responsible for ensuring all sellers provide the required information for all active listings. Non-compliance can result in a ban on selling a particular product starting December 13th, 2024.
Providing the Information
Until recently, compliance information had to be provided by every seller for each of their active listings. However, this requirement now seems to have shifted to a per-listing basis. This means that larger, more popular listings are likely already supplied with the necessary information, leaving only smaller or less active listings requiring manual input from sellers.
To identify which listings still need information and to provide it, you can access the relevant section in your Seller Central account by navigating through the menu: Performance -> Account Health -> Product Policy Compliance, or directly via this link.
Once you open the Product Policy Compliance Dashboard, you will see a table displaying your products, the required information, potential consequences of non-compliance (in most cases, "Listing at risk of removal"), and an "At-risk sales" column.
It’s important to note that the "At-risk sales" column does not indicate potential future sales you might miss out on but rather past sales where liability issues could arise. Therefore, it often doesn’t make sense to prioritize listings with a high value in this column. Instead, focus on providing information for products that you currently have in stock.
The required information in the compliance overview can be divided into four categories:
1. Contact Details of the Manufacturer and the Responsible Person
The manufacturer and the responsible person are the same in cases where products are not imported from outside the EU. To find the correct address, you can either check the product packaging or search online. You can use Google to find out more about the manufacturer. In most instances, the official website will provide the relevant detail to enter into the form. Oftentimes, the brand and the product you’re selling might appear as separate rows in the compliance table, and the information needs to be entered and confirmed for both.
Important: Do not enter your own contact information here, as this could lead to serious liability issues.
To submit the information, all you need to do is click on „submit“ on the right hand side of each table row. A widget will open up so you can enter the required detail.
Submissions will usually be reviewed and approved in the matter of a few seconds. If your submission is rejected, this can be caused by inputting the info in a wrong format. Check all relevant fields for potential errors and try to resubmit the info again.
A handy trick to verify if you’ve found the correct details is to check another listing from the same brand (preferably for a similar product) on Amazon. Navigate to the "Safety and Product Resources" section, where the GPSR compliance information is displayed. By clicking on "Safety Images and Contacts", a widget will open, allowing you to view the details that other sellers have entered.
For products imported from outside the EU, additional legal requirements and liability risks apply. In such cases, we strongly recommend consulting a lawyer before selling the products on amazon and filling out the compliance information.
2. Warning and Safety Information
Warning and safety information is often the most challenging category to complete. The best method is to take clear photos of all sides of the product packaging to capture all displayed safety details.
In some cases, manufacturers may include the required information in the product manual. If this is available online, you can theoretically download and upload the manual instead. However, this approach often proves unreliable, so we generally recommend using photos instead.
3. EPR (Extended Producer Responsibility)
Based on our current understanding, compliance here is linked to providing a WEEE number when ungating new listings. There’s nothing specific that needs to be addressed in this category in regards to GPSR. These Numbers can be found here.
4. Various Other Alerts
The overview may also include other alerts unrelated to GPSR, such as pricing adjustments or other actions required to reactivate certain listings.
Additional Notes
After entering all the required information, it may take a few days for it to be reviewed and confirmed. To ensure that your product listings remain active, we recommend checking the compliance overview regularly — ideally every couple of days.
