User Agreement for A.L.I.C.E, the APEX AI-Supported Product

This User Agreement ("Agreement") governs the use of APEX's AI-Supported product, A.L.I.C.E. By accessing or utilizing the Product, you consent to comply with this Agreement. Non-compliance with any provisions herein will terminate your privilege to use the Product.

Product Overview
1.1 A.L.I.C.E provides AI-enhanced strategies and automation for the capital markets industry.
​
1.2 APEX uses advanced technologies to curate effective trading strategies, tailored for individuals, quants, traders, and portfolio managers.
​
Product Use and Governance
2.1 As per this Agreement, the Product can be used for lawful purposes, for individual, internal business use only.
​
2.2 APEX extends a non-exclusive, non-transferable, revocable license to use the Product, subject to this Agreement.
​
2.3 Any form of hacking, manipulation, or disruption of the Product is strictly prohibited and constitutes a breach of this Agreement.
​
2.4 APEX reserves the right to monitor your use of the Product to ensure adherence to these terms, maintain the Product's functionality, and protect stakeholders' rights.

Intellectual Property Policies
3.1 APEX holds all rights, titles, and interests in the Product, including intellectual property rights.

Warranty Limitations and Liability
4.1 The Product is provided “as is," without any warranties, implied or expressed.
​
4.2 APEX disclaims any assurance for an error-free, uninterrupted experience and doesn't affirm the complete accuracy or reliability of any provided information.

Termination
5.1 APEX reserves the right to suspend or terminate access to the Product at its discretion.
​
Applicable Law & Jurisdiction
6.1 This Agreement is governed by the law of APEX's jurisdiction. Any arising disputes will be resolved exclusively at APEX's locale.

Data Security and Privacy
7.1 At APEX, the security and privacy of our customer's data is our priority. We ensure that data from documents is not used to train our model and is permanently deleted after 30 days.
​
7.2 All customer data is end-to-end encrypted at REST with AES-256 and in transit via TLS. Sensitive data like access tokens and keys are encrypted at the application level before storage.
​
7.3 APEX uses Stripe for payment processing and does not store personal credit card information. Stripe bears a PCI Service Provider Level 1 certification, the highest certification in the payments industry.
​
7.4 APEX regularly conducts penetration tests with industry experts to maintain secure systems.
​
7.5 All customer databases are backed up daily for data fidelity.
​
Amendments and Entire Agreement
8.1 APEX reserves the right to modify this Agreement at any time.
​
8.2 This Agreement is the comprehensive agreement concerning the use of the Product.
​
By using A.L.I.C.E, you acknowledge and accept this User Agreement.
​
Liability Limitations
9.1 As far as the applicable law permits, APEX and its affiliated entities are not responsible for any direct, indirect, incidental, consequential, or exceptional damage arising due to the use or inability to use the Product, even if notified of the possibility of such damages.
