As of January 27, 2025, the updated TCPA regulations, including the one-to-one consent requirement, are officially in effect.
These new rules are designed to enhance consumer protection and require businesses to:
Obtain explicit, consumer-specific consent before sharing their information with another company.
Ensure consent is specific to a single, identified company (general or blanket consents are not allowed).
Provide consumers with clear opportunities to opt out of receiving further communications.
We’re proud to share that Baton’s referral processes already comply with these standards, ensuring that every lead is sourced with explicit, consumer-specific consent.
Here’s a breakdown of how each referral method works and remains compliant:
1. Referrals Submitted via the Baton Portal
How It Works: When a company identifies a consumer whose needs they cannot fulfill, they verbally obtain consent using clear language, such as:
“We don’t provide that service, but I can connect you with a trusted provider who does. Would you like me to send your information to [Provider Name]?”
After the consumer agrees, the company submits their contact information through the Baton portal, affirming consent by selecting a checkbox.Compliance: Once submitted, the consumer instantly receives a text message with the referred company’s name and contact details. This ensures transparency and gives the consumer the choice to call the company directly or wait for the company to contact them.
Why It Matters: This method guarantees that referrals are made to a single, specific provider with the consumer’s explicit consent, fully satisfying the updated regulations.
2. Referrals from the Service Pros Team
How It Works: Consumers are either forwarded to our Service Pros team by a referring company or call us directly for assistance. During the call, we take the time to understand their needs and identify a trusted provider in our network who can help.
Compliance: Before connecting the consumer, we clearly state which company we’re transferring them to and provide them the opportunity to decline the referral. Only after the consumer confirms their consent do we proceed with sharing their information or connecting the call.
Why It Matters: This process ensures compliance by obtaining explicit, one-to-one consent for each referral.
Baton’s Value to Your Business
Baton has always prioritized compliance and trust, setting us apart from traditional lead generation sources. Every lead comes from a consumer who has actively sought help, been qualified by a referring company or our Service Pros team, and provided explicit consent to be connected with a single provider. This minimizes risk, increases conversion potential, and ensures a seamless experience for both you and your customers.
