What services does BDV Solutions provide to assist people to obtain the EB-3 visa?

BDV Solutions, LLC, of Greenville, South Carolina, is an employment-based immigration consulting firm that connects employers seeking workers with potential immigrants. We assist and consult employers and foreign nationals through the process of obtaining the EB-3 unskilled visa.

Is BDV Solutions a law firm?

Why Doesn’t BDV Solutions Find Employers For Chinese and Indian Nationals?

Under American immigration laws, the number of permanent residences or “Green Cards” that can be issued is limited to only 140,000 per year for employment-based cases. However, millions of people apply for Green Cards. Because of this, a queue or backlog for visas has been growing each year of immigrant visa applicants. Only a certain number of the 140,000 per year is allocated for each country and each visa category. In order to file for a green card application and a work permit, the foreign national’s country must not be in the backlog. China and India have significant backlogs because of the size of the pool of people who have applied for immigrant visas.

Thus, any Chinese or Indian national would need to wait many years before they could start working at a company and the employers who work with BDV generally cannot wait that long to receive workers. Therefore, regrettably, BDV Solutions cannot assist foreign nationals from these countries.

Can BDV Solutions, LLC guarantee that I will obtain the visa?

While BDV Solutions is committed to ensuring foreign nationals are placed with sponsors in need of labor, it cannot guarantee the issuance of a U.S. visa. BDV Solutions LLC is not a law firm and does not present itself as such. The hiring of any consultant, attorney, or employment placement agency is an important decision that should not be based solely on advertisement or word of mouth. The outcome of each case depends upon many factors, including the facts of the case, and no attorney, consultant, or entity can or should guarantee a positive result in any case. Therefore, BDV Solutions, LLC makes no guarantees, warranties, or predictions about the outcome of any visa application.

Further, we make no representations that the quality of the legal work to be performed by law firms or attorneys we work with is better than the quality of legal work performed by other attorneys. Prior results by BDV Solutions and those law firms we work with do not guarantee a similar outcome.

Does BDV Solutions, LLC have a refund policy?

BDV Solutions, LLC has a strict No Refund Policy. Any payments to BDV Solutions LLC are for services already rendered as per the Terms and Conditions of the placement contract. Each foreign national, when they sign their contract, agrees that he or she understands that all payments are for services that were already rendered.

What is the relationship between BDV Solutions and the Employers?

BDV Solutions is an employment-based immigration consulting firm that assists companies in identifying foreign nationals for employment pursuant to the EB-3 Visa program of the Immigration and Nationality Act (“INA”) and applicable laws and regulations of the U.S. government. While BDV works in conjunction with U.S. based employers to find workers, BDV does not pay these U.S. based employers nor do they receive any funds and any other benefit from them.

While BDV may recommend workers to the employer, they are under no obligation to hire foreign nationals we may present to them. Should the candidates presented by BDV be selected for an open position at the employer, their Human Resources Department or similarly situated Department will initiate the required labor certification process for hiring the foreign nationals and conduct the labor certification process of structured advertising and recruiting at their own expense. If approved, a third-party law firm will manage the immigration visa process for the prospective foreign nationals. The employers and BDV sign an agreement which states that no compensation will be paid by the employer to BDV for identifying foreign workers and BDV provides no compensation whatsoever to the employer for its sponsorship of foreign workers or program participation.
