You should work a full-time schedule every week: that means 35-40 hours, according to the schedule given you by your sponsor. Some jobs will require overtime, so you will sometimes be working more than 40 hours, but you should be working NO LESS than 35 hours per week.

Why is this important for my case?

It's important that you work full-time hours (35-40) because of USCIS rules and regulations for the EB3 program. Here are 2 reasons:

1) If you get called for an interview (or you receive a home visit from an officer) and you are not working full-time hours, the officer may question your intent to work for your sponsor as a full-time EB3 worker. Showing paystubs from your sponsor stating full-time employment (in the role on your LC) is the best way to prepare for a successful interview.

2) If your sponsor receives a site visit from an immigration officer, they will probably talk to both your sponsor and you about working full-time, ask to see your schedule, and make sure you are working full-time hours.

Can I work part-time?

No, it is not possible to work part-time for your sponsor during your 12-month contract.

If you are interested in working part-time after you have worked for 1 year and your green card is pending, see this article. Our immigration attorneys advise you to continue working an EB-3 Unskilled job full-time to protect your pending immigrant petition.
