How long should I work?

First - If you are considering leaving your sponsor because of a difficult issue, please consult with BDV Client Services by Chat so we can best advise you of your options and best practices.

If you leave your job before your 12-month commitment is complete, your I-140 may be withdrawn by your sponsor. (I-140 approval is the basis for your green card).

The sponsoring employer has the right to withdraw your approved I-140 petition and notify the USCIS Fraud Unit if they suspect you lacked willingness to work.

The I-140 is the petition that forms the basis of a Consular or AOS EB-3 immigration case. Without an I-140, the case stops or can be withdrawn. Previously approved I-140's that have been withdrawn can be scrutinized for fraud. Fraud claims on an immigration case could result in removal of permanent residency (green card).

Remember, sponsoring employers receive no benefit from the EB-3 program other than potential candidates for employment. They receive no money or other benefit. And it takes considerable time for the employer to draft, review, sign and communicate with BDV and the legal team on your behalf.

The employer sponsors you because they have a labor shortage; many of our sponsors depend on EB-3 workers such as yourself in order to survive as a business. And, it is tremendously in your benefit to perform the work period in a satisfactory manner.

Please keep in mind that our clients are not "forced" to work for their sponsoring employer, as each client signed up for this opportunity on their own. However, it is in their interest to do so for now and in support of future plans.

So, we urge you to work in good faith for your sponsor.

Take pride in your work, and in your word as well, upholding the contract you signed with BDV. Do what you promised you would do. Immigration is a privilege, not a right, so be mindful of this wonderful chance and take it seriously. The work period is not always fun. It can be hard. It can be work you are not accustomed to doing. But it is finite. There is light at the end of the tunnel!
