BDV Client Services is here to help you navigate the commitment with your sponsor and to help you generally during this employment period.
We will advocate on your behalf when we feel it is prudent to do so, and we will provide guidance in your interest as long as you are working in good faith to fulfill your commitment.
We will also treat you with respect and treat your issues with confidentiality during this post-hire period.
What we do:
Our goal is to help you stay in your EB-3 job for the duration of your 12+ month commitment to your sponsor, or until you receive your green card. We exist to foster a good relationship between both our clients and our sponsors.
We can be a liaison between you and the sponsor for any significant issues that rise above typical, day-to-day concerns that you are unable to solve by speaking with your management and your sponsor's Human Resources (HR).
We can:
Assist you or your sponsor in the case of a USCIS Officer visit
Give you guidance based on USCIS' requirements for EB-3 workers (for job duties, hours worked, etc.)
Help answer your questions about wages, hours, promotions, time period worked, retrogression, working during pending cases, etc.
Help you navigate complex situations at work regarding co-workers or managers
Be available for advice if you receive a workplace injury
Connect you with advice for preparation for a 485 interview (AOS clients)
If you have a significant issue or concern at work, please reach out to us as soon as possible. Let us know the issue, and the more details you can provide, the better. We can contact the sponsor, if needed, to bridge any miscommunications.
What we do not do:
BDV Client Services is not your employer; we are not a staffing agency or a branch of your sponsor's Human Resources Department. We do not control the business needs or practices of your sponsoring employer. If your sponsor makes a decision you do not agree with, we cannot guide the sponsor in how to run their business.
โ
We cannot:
Negotiate schedules (ask the sponsor to change your shift or change your hours)
Contact the sponsor to revoke any decisions they have already made (ie - denying time off, etc.)
Discuss one-off sick days
Assist with timecard issues or payroll issues
Discuss another client's case or job details with you
Request a raise or promotion for you
Ensure that you will be re-hired if you are terminated
Help you leave your job before 1 year for unapproved reasons
Find another BDV sponsor for you
Also, we are not your attorney and we do not provide legal advice.
However, when needed, we may be able to connect you to an attorney or ensure you get the legal answer you need from outside counsel.
