At BDV Solutions, we aim to assist foreign nationals in the process of obtaining an EB-3 Unskilled visa and ultimately a green card in the US. Here is a detailed description of each step involved in the application process:
How to become a client:
Create an account and fill out the application on our website: Prospective clients are required to create an account on our website. They will then be prompted to complete an application form, providing their personal information, employment history, educational background, and other relevant details. Our application form is designed to assess the eligibility of individuals for the EB-3 Unskilled visa program.
Wait for application review / approval: Once the application is submitted, our dedicated sales team will review it to ensure that the applicant meets the initial eligibility criteria for the program. This review process helps us verify that the applicant's background aligns with the requirements set by the US immigration authorities for the EB-3 Unskilled visa category. Our sales team may contact the applicant for any additional information or clarification needed before proceeding to the next steps of the application process. We strive to ensure that our clients are suitable candidates for the EB-3 Unskilled visa program, and our sales team's review helps facilitate a smooth and efficient application process for those who meet the initial eligibility criteria.
Selecting a job on our website: Users can browse through our job offerings page to explore job opportunities available through our network of employers. They can search for positions that match their location preference and job preference, based on what it available.
Signing a contract with us: Once the user finds a suitable job, they enter into a digital contract with BDV Solutions, signed online via DocuSign. The contract outlines the responsibilities and obligations of both parties throughout the process.
Making the first payment: To become a client, the user is required to make an initial payment as specified in the contract. None of these fees are ever paid to the employer sponsor.
Once you become a client:
Labor Certification (Form 9089) stage: BDV Solutions works closely with clients to prepare the necessary documentation for the labor certification process. This includes obtaining a prevailing wage determination and filing Form 9089 with the Department of Labor (DOL).
I-140 Immigrant Petition: After obtaining the approved labor certification, we assist clients in preparing and submitting the I-140 Immigrant Petition for Alien Worker to the United States Citizenship and Immigration Services (USCIS). This form is filed on behalf of the client by their prospective employer. I-485, I-765, I-131 (for clients adjusting status from within the US): For clients already residing in the US and seeking to adjust their status, we guide them through the preparation and submission of the I-485 Application to Register Permanent Residence or Adjust Status. Additionally, we assist with filing the I-765 Application for Employment Authorization and the I-131 Application for Travel Document.
Final visa interview: Once the client's I-140 is approved and priority date is current, the final step of the EB-3 Unskilled visa process is the visa interview, which takes place at a local US consulate or through an interview with the United States Citizenship and Immigration Services (USCIS) for applicants adjusting their status within the US. During the interview, applicants must provide required documents and answer questions related to their background, employment, and immigration intentions. Consular officers or USCIS officers assess the applicant's eligibility and make a final determination based on the information provided. Being well-prepared and providing accurate information is crucial for a successful outcome.
Approval: Upon successful approval in the visa interview, applicants will receive a visa, often referred to as a temporary green card. After entering the US, the physical green card, which serves as official proof of permanent resident status, will be mailed to the provided address. Once received, it grants the rights and benefits of permanent residency, including the ability to live and work indefinitely in the US.
