We generally do not recommend switching employers while the I-485 is still pending. However, you may be able to do so if the new position satisfies the "same or similar occupation" requirement for changing roles.

If you have satisfied your commitment to BDV by working for your sponsor for at least 1 year, first consider staying at your sponsor until the arrival of your green card. This will be the easiest decision for your case.

However, if you need to move to another sponsor, please reach out to our Client Services Department and inform us of your desire to port. We will place you on a "porting list" with your attorney.

After we inform your attorney, they will submit a Supplement J form to the government. Please note that this legal work is an additional fee, and it is not included in your contract with BDV.

If Retrogression is the reason that your green card is pending, please see this article.

If your green card is still pending, the most important thing to remember is to keep working in an unskilled job that is a "same or similar occupation" to your LC role. This is so that if you receive an interview or RFE before your green card is approved, you will be able to prove to USCIS your intent to work.
