My LC received an audit. What should I do?

Audits are issued at random, and we cannot predict which Labor Certifications (LCs) will or will not receive an audit. Receiving an audit does not mean that something was wrong with your case; it is a random selection.

The most common request in the LC audit is for recruitment documents, proving that the employer completed all steps of recruitment before the LC was filed. Unfortunately, the Department of Labor (DOL) does not allow these documents to be submitted at the time LCs are filed, so the DOL issues random audits if they want to see these documents. The employer already has all the documents required to respond to the audit.

Your employer will respond to the audit from the DOL. If any additional information is required from you, we will contact you for the relevant information. Otherwise, if no information is required from you, the audit will be submitted within 30 days of receipt. Once the audit response is sent, it usually takes about 4 months for a response from DOL.
