How do I request time off from my sponsor?

Time off requests are one of the most frequent requests we hear from BDV clients.

Unfortunately, misuse of time off is one of the most frequent complaints we hear from BDV sponsors as well.

BDV Client Services wants to empower you to use the time off given to you in a way that complies with your company's policies. We also want to warn you of any consequences of taking too much time off or taking time off in ways that are unapproved by your sponsor.

Things to remember about requesting time off:

  1. Check Policies: Before requesting time off, make sure you understand your sponsor's policies on vacation and leave. Contrary to work culture in other countries, time off is not guaranteed. Some companies may allow time off after one year of employment, but it is necessary to confirm this with your manager or HR department. Taking time off without approval may result in termination, which can impact your immigration status.

  2. Plan & Approve: If you do wish to take time off, ensure you plan well in advance and seek approval from your sponsor first. This will help avoid any issues that could jeopardize your process, including miscommunication with your employer about your continued employment.

  3. Longer leave: Long periods of leave, especially without sponsor approval, are not typically permitted and could lead to the termination of your employment, which may affect your petition. It is always safer to maintain consistent, full-time employment until your I-485 is approved.
