Form I-485 Application to Adjust Status is the form the EB-5 investor files to change from nonimmigrant status to conditional permanent residence status, i.e. to get the conditional green card. The EB-5 investor may file I-485 only if they are lawfully in the United States and the I-526 petition is approved.

Approval for the I-485 application typically takes 6 to 12 months. However, EB-5 investors can simultaneously apply for work and travel authorization while their I-485 application is being processed if they also file an I-765 Application for Employment Authorization and I-131 Application for Travel Document.

Upon I-485 approval, the EB-5 investor receives a 2-year conditional green card. At the end of the 2-year conditional residence period, the EB-5 investor may file the I-829 petition to remove conditions for the permanent green card.
