BigDayMade Inc., a Delaware corporation and our affiliated entities (“us”, “we” or “our”) operate https://bigdaymade.com and related applications (collectively, the “Service”) to inspire and inform engaged couples about vendors and venues available for their wedding day. This policy (“Privacy Policy”) informs you of our policies regarding the collection, use and disclosure of information when you use the Service. By using the Service, you consent to our collection, use and disclosure of information about you as described in this Privacy Policy. Additionally, our Terms of Use are incorporated by reference into this Privacy Policy, including applicable terms governing limitations on liability and the resolution of disputes. 

1. Information Collection and Use

Information may be collected by us automatically during use of the Service, directly from you or from third parties. We collect and store the information that you post to the Service, including your photos, comments, reviews, preferences and profile information. By posting on the Service, you agree to permit us to disclose publicly the material you post. Information that you post publicly on the Service (e.g., photos, comments, your profile) will be made publicly available to other users of the Service. The information that you post to the Service is intended for public consumption, including your photos, comments, Collections, and profile information. If you elect to link your BigDayMade profile to a social network or online platform and you opt to share your contacts with us, we may notify those contacts that you have signed up with the Service so that you and your contacts can interact with each other on the Service. We also collect your name, contact information, and other information provided by you when you create an account and profile. Any information you provide for your profile may be displayed publicly on the Service. In your account settings, you may tailor the extent to which some of your information is available publicly. If you feel that an unauthorized account has been created using your name or your likeness, please make a change request by contacting us at support@bigdaymade.com and providing us with truthful information concerning your change request. We also collect information when you communicate with us through the Service or via email, phone, chat or otherwise. We may keep a copy, record or recording of such communications in accordance with applicable law. You may also contact third party product and/or service providers through the Service. We strongly advise you to review the privacy policy of every third-party site you visit. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party providers, and any information you send to such providers is not covered by this Privacy Policy. If you purchase products or services within the Service, we collect certain information in order to process your request, such as your phone number, address, email, and credit card or bank account information. We collect this information for the purpose of providing the Service, identifying and communicating with you, responding to your requests/inquiries, servicing your purchases, improving our products and services and as otherwise provided in this Privacy Policy.

2. Information Sharing

We may permit other users and our partners to contact you through the Service, including for marketing purposes, but we will not rent or sell your email address or other personal contact information to third parties for their own marketing purposes. We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services and/or to assist us in analyzing how our Service is used. These third parties have access to your information only to perform specific tasks on our behalf and are obligated not to disclose or use your information for any other purpose. We will disclose your information where required to do so by law or subpoena or if we believe that such action is necessary to comply with applicable law and the reasonable requests of law enforcement, or to protect the security or integrity of our Service.

3. Communications

We may use your information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us, and we will unsubscribe you within the earlier of 10 business days after receiving such request or as required by applicable law. By signing up for the Service, you agree to receive feedback and communications from third-parties within the Service, including third-party providers of products or services who may comment on your postings within the Service. If you don’t want third parties to see such information, you should not post it to your profile or the Service.

4. Cookies 

Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device. We use cookies to collect information in order to improve our services for you. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. The help feature on most browsers provide information on how to accept cookies, disable cookies or to notify you when receiving a new cookie. If you do not accept cookies, you may not be able to use some features of our Service.

5. Log Data

We may also collect information that your browser sends whenever you visit our Service ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics. In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase our Service's functionality. These third-party service providers have their own privacy policies addressing how they use such information.

6. Web Beacons

Web beacons, also known as gifs, are electronic images that may be used on the Service or in our emails. A web beacon may be used on our web pages to collect information, deliver cookies, count visits, compile statistics on usage and campaign effectiveness and in our emails to tell if an email has been opened and acted upon.

7. Do Not Track

Please note we do not change system behavior within the Service in response to browser requests not to be tracked, but you may disable cookies or opt out of the use of third-party analytics as discussed above. 

8. Third Party Advertising

We may use third-party advertising service providers to serve advertisements on the Service. These providers may use cookies, web beacons or similar technologies to serve you advertisements tailored to interests you have shown by browsing on the Service. These providers may collect non-personal data such as your browser type, your operating system, web pages visited, time of visits, content viewed, ads viewed, and other clickstream data. The use of cookies, web beacons or similar technologies by these advertising service providers is subject to their own privacy policies rather than this Privacy Policy. 9. Plug-ins and Social Media Widgets

Our Service may include social media features and widgets, such as the Facebook “Like” and “Share” buttons, as well as other interactive mini-programs that run both on our Service and on third-party websites, and enable certain features to work (e.g., blogs and comments). These features may collect your IP address, which page you are visiting, and may set a cookie to enable the feature to function properly and for other purposes. When these features are displayed on our Service they are hosted by third parties, and are subject to their own privacy policies, not this one. Your interactions with these features are governed by the privacy policy of the company providing them.

10. Third Party Profile Pages

Third party businesses like wedding vendors and venues may maintain profile pages on the Service. We may collect certain information, including your communications, sent through these profile pages. Our use of information we collect is governed by this Privacy Policy.

11. Choice and Access to Your Information

You may change any of your information in your account by sending an e-mail to us at support@bigdaymade.com. You may request deletion of your information by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives.

12. Business Transfers

If we are acquired by or merged with another entity, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer your information to the other company. We may also disclose certain personal information to a company as part of the planning or review for a potential merger, acquisition or transfer of assets.

13. Account Termination and Data Retention

You may at any time terminate your account by going to your account settings or by contacting us at support@BigDayMade.com. Your public profile will be deactivated. However, unless prohibited by applicable law, postings or comments you provided to the Service prior to closing your account, will remain public. We also may retain information about you for the purposes authorized under this Privacy Policy, including a copy of your account information as part of our business records, unless prohibited by law.

14. Children

Only persons age 18 or older have permission to access our Service. Our Service does not address anyone under the age of 13 ("Children"). We do not knowingly collect information from children under 13. If you are a parent or guardian and you learn that your child has provided us with any information, please contact us at support@bigdaymade.com. If we become aware that we have collected information from a child under age 13 without verification of parental consent, we will take steps to remove that information from our servers.

15. Security

The security of your information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information transferred to and stored by us, in order to protect it from unauthorized access, destruction, use, modification, or disclosure. However, we cannot guarantee security as no method of transmission over the Internet or via mobile device, or method of electronic storage, is 100% secure. You should take certain steps to protect your account and personal information as well, such as by choosing a strong password and keeping such password private, and logging out of your account when you are finished using it.

16. International Information Transfer

Your information may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. If you are located outside United States and choose to provide information to us, please note that we transfer the information to the United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

17. Canadian Anti-Spam Legislation

We are committed to ensuring that all applicable recipients of our commercial electronic messages (CEM’s) receive them in a manner that is consistent with Canada’s Anti-Spam Legislation (CASL). We will continue to send CEM’s to applicable recipients in the following contexts: you have provided us with your email address directly without indicating a desire not to receive CEM’s; you have published your email address online or otherwise; you have explicitly informed us (verbally or otherwise) that you are interested in continuing to receive CEM’s; you have a business relationship with us; we are responding to a request for information from you; or a third-party with whom you have an existing relationship has referred us to you. In the event you no longer wish to receive CEM’s from us, email us at support@BigDayMade.com or reply to the electronic message / email address sent to you, with the word “Unsubscribe.” Our CEM’s also contain this information on how to unsubscribe from receiving CEM’s. Your request will be processed as soon as possible, and no later than ten (10) days after you send the request.

18. Changes to this Privacy Policy

This Privacy Policy is effective as of the date specified above and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page. We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
