This is DivorceVirtual's refund policy for the $295 divorce service fee and for court filing fees paid through us. It applies to every case, whatever the reason for cancelling.
When you always get a full refund
We refund the full $295 service fee, at any stage of your case, if:
We can't take your case because of your children. We can only prepare uncontested divorces for couples with no minor children, so we can't take your case if you and your spouse have a child together under 18, a child still in high school, a child on the way, or an adult child who depends on you because of a disability. Grown, independent children don't count.
The court rejects our forms because they don't comply with the court's format.
Cancelling for any other reason
How much you get back depends on how far your case has gone. You can see your current step on your dashboard.
Where your case is | What you get back |
You've paid, but your first documents haven't been generated yet (Step 1, Initial Information Gathering) | A full refund |
Your first documents have been generated, but your final documents haven't (Steps 2 to 6) | 50% of the service fee |
Your final documents have been generated, or your case is further along (Steps 7 to 10) | No cash refund. Instead, a credit for the full amount you paid, to use on a future DivorceVirtual service. The credit doesn't expire. |
The same table applies if your spouse won't sign, or if you and your spouse decide not to divorce.
If your case has already been filed with the court and you no longer want the divorce, you need to ask the court to dismiss it. We can't withdraw a case from the court for you. The Utah Courts Self-Help Center (utcourts.gov) can help.
Court filing fees
If you paid your court filing fee through us, we refund it in full as long as we haven't yet paid it to the court. Once we've paid the court, that money is with the court, and we can't get it back.
Pausing instead of cancelling
You don't have to cancel to take a break. Your case stays exactly where it is, at any step, until you come back to your dashboard. Pausing costs nothing and doesn't affect your refund.
Correcting your answers
If you entered something wrong, we can reset your case so you can fix it, at no extra charge. A reset isn't a cancellation, so it doesn't come with a refund.
How refunds work
Refunds go back to the card or account you paid with. If you paid through one of our partners, such as VirtualMarriage, Courtly or Imigrata, the refund goes back the same way. For Courtly and Imigrata, the partner issues it.
A refund usually takes 5 to 10 business days to appear on your statement, depending on your bank.
We email you when we process a refund.
How to ask for a refund
Message us from the chat on your dashboard, or email support@divorcevirtual.com. Tell us which case you mean, and we'll confirm what you're eligible for before we do anything.
