Terms and Conditions of the prize trip

Article 1: Organizing Body

A. Evaneos, incorporated and registered with the commercial register in FRANCE under registration number SIRET 51319112200060 of Greffe du Tribunal de Commerce of Paris, whose registered office is in 27 rue de Mogador, 75009 PARIS; and

B. Aon France trading under the trademark Chapka Assurances. Incorporated and registered with the commercial register in FRANCE under registration number SIREN 414 572 248 of Paris Trade and Companies Register whose registered office is in 31-35 rue de la Fédération 75717 Paris Cedex 15.

C. Europ Assistance, incorporated and registered  in the Nanterre commerce and companies register under the number 51 366 405, whose registered office is in  1, Promenade de la Bonnette, 92230 Gennevilliers, France.

D. VizEat Ltd / Eatwith, whose registered office is Dowgate Hill House, 14-16 Dowgate Hill, Cannon Street, Office G07, London, United Kingdom EC4R 2SU under company number 08627663.

Article 2: Overview of the Competition

A. There is one winner and one prize.

  1. The prize includes flights, accommodation, and activities for two persons.

  2. Total winnings for the trip are outlined below.

B. The winner will be selected at random from all valid entries for this competition received before the Closing Date of February 15, 2020. 

C. The winner will be notified by email or using the other contact details provided by the winner within seven days after the Closing Date. All reasonable endeavours will be made to contact the winner during the specified time. If a winner cannot be contacted or is not available, the Promoter reserves the right to re-draw another winner from the valid/correct entries that were received before the Closing Date.

D. The prize entitles the holder to a tailor-made trip for two persons worth $2,000 USD, booked via Evaneos’ local travel agent based in Paris, France.

 E. The prize is for a tailor-made trip itinerary covering: airport transfers, 4 nights accommodation, transport, and on-the-ground activities and visits, up to a total value of $2,000 USD, and an Eatwith experience for two people, selected by Eatwith according to availability to the value of $320 USD.. 

 F. Should the trip itinerary desired by the winner of the prize trip come to a total value of more than 2,000 USD, the winner is required to pay the difference themselves. 

G. The prize trip is valid for two persons, specifically two adults. Travelers must be older than 18 years of age to submit.

 H. The winner of the prize trip must contact Evaneos’ local travel agent to begin planning their trip no later than three months before their intended departure date. Dates requested are subject to availability.

 I. The prize trip must be taken before December 2020.

J. The prize does not include travel insurance, visa fees (if applicable), optional activities once traveling in the destination, spending money, or gratuities.

 K. Flights are included. The allowance per person is $700 USD or a total of $1,400 USD. This includes round-trip flights from the airport of the winners choosing. 

 L. Should the flights exceed $1,400 USD total, the winner is required to pay the difference themselves.

 M. The winning person of the prize trip must hold a valid passport, with six months or more remaining after return to their home country.
The accompanying person must also hold a valid passport, with six months or more remaining after return to their home country.

 O. The prize trip is non-transferable and there are no cash alternatives to the prize in whole or in part.

 
Article 3: Selection of winner

A. The Winner will be chosen randomly among participants after the necessary verification of their eligibility to gain the prizes. If a participant does not respond or make him or herself known within the month following this email, (s)he will be considered as having renounced his or her prize, and the prize will remain the property of the Organising Body. 

B. The Winner must comply with the Terms and Conditions of the competition. If it is discovered that (s)he does not correspond to the criteria of the present Terms and Conditions, his or her prizes will not be attributed to him or her. Participants authorise all necessary verifications concerning their identity, their age, their postal address or the faithfulness and sincerity of their participation. The Organising Body therefore reserves the right to ask for a copy of the Winner’s proof of identity before sending them their prize. Any false declaration, or indication of a false identity or address will bring about the immediate elimination of the participant, and if necessary, the reimbursement of the prizes already sent. 

 

Article 4: Distribution of Prizes

A. Following the participation and announcement of winner as described in Article 4, the winner will receive all necessary information regarding the presentation of their prizes via email within 15 days (excluding weekends and bank holidays) of the winner being announced. The prizes will be sent to the winner by email.

B. The Organising Body will not be held responsible for sending prizes to an inaccurate or incomplete postal address resulting from the negligence of the winner. If the prizes cannot be delivered to the recipient for whatever reason, independent from the wishes or intentions of the Organising Body, (the winner having moved address without providing their new address, etc...), the prizes will remain the property of the Organising Body indefinitely.   

C. Prizes cannot be exchanged with another object, nor exchanged for money, and cannot be partially or totally reimbursed. 

 

Article 5: Limit of Liability

A. By participating you are confirming that you acknowledge and accept the characteristics and limits of the internet, particularly those concerning technical performance, response time taken to see, question, or transfer information, the risk of losing connection, and more generally, the risks inherent in all connection and transmission on the internet, the absence of protection of certain data against potential hackers, and the risk of contamination by viruses present on the network. As a result, the Organising Body will not under any circumstances be held responsible for: (non-exhaustive list)   

  1. The transmission and/or reception of all data and information on the internet;

  2. All malfunctioning of internet network affecting the competition to run or function correctly;

  3. The breakdown of reception or lines of communication;

  4. The loss of all physical or electronic post, and more generally, the loss of data;

  5. Problems of delivery/conveyance;

  6. The functioning of all software;

  7. The consequences of all viruses, bogus information, anomalies, technical faults;

  8. Any or all damage caused to the participant’s computer/server;

  9. All technical faults, including equipment or software of any nature that might have affected or limited the possibility of participating in the competition, or that might have damaged the participant’s computer/server;  

  10. Malfunctioning of the prizes given to the winner and related to the competition, and any potential damage directly or indirectly caused by these prizes.  

B. The Organising Body will not be held responsible for any damage directly or indirectly deriving from the breakdown, malfunction (for whatever reason), or any directly-resulting damage, of connection with the website created for the competition. It is the responsibility of the participant to take all appropriate measures to protect their own data and/or the software stocked on their servers against all threats. The Organising Body can remove all or any single part of this competition if it is discovered that fraud has taken place in any form, particularly that of a technical nature, or in the selection of winner. The Organising Body therefore reserves the right not to attribute prizes to fraudsters, and/or proceed to judicial means to deal with them. The Organising Body will not be held responsible in any way for any damage or inconvenience caused to participants by potential fraudsters.   

C. The Organising Body reserves the right to ban anyone whose fraudulent behaviour affects the smooth-running of the competition permanently from other competitions. Encouragement of the use of fictitious persons in the competition will additionally result in the immediate elimination of the participant. Any attempt to use the competition outside the dedicated interface created on the website will similarly be considered as fraud.

 

Article 6: Legal Disputes

A. The present Terms and Conditions comply with French Law. In order to be put into practice, any potential disputes arising from the competition must be set out in a written letter to the following address: Marketing and Communication Department, 27 rue de Mogador, 75009, Paris, France, within a maximum of ninety (90) days after the deadline for participation in the competition as indicated in the present Terms and Conditions. In the case of persistent disagreement over the application or interpretation of the present Terms and Conditions, and failing amicable agreement, legal disputes will be laid out before the court or tribunal, whereby exclusive jurisdiction is conferred. 

Article 7: Personal Data

A. You are reminded that in order to get their prizes, the winner must provide certain personal information concerning him/her (name, address). This information is collected and saved in a computer file and is necessary for the distribution of prizes. This information is accessible to the Organizing Body, and may be transmitted to its technical service suppliers and to a supplier involved in the distribution of prizes. In accordance with the Data Protection Act (no. 78-17) of 6th January 1978, participants reserve the right to deny, access, modify, and delete any personal information relating to them. In order to exercise these rights, participants must send a letter to the following address: 27 rue de Mogador, 75009, Paris, France.

Article 8: Regulation

A. From the time and date that the competition is launched, the competition and its participants are subject to the Terms and Conditions as set out in the present document. The Terms and Conditions are available free of charge to any people who request these from the Organizing Body, by writing to the following address: 27 rue de Mogador, 75009, Paris, France. Stamps used in the written request to have a copy of the Terms and Conditions will be reimbursed based on the tariff of a second-class stamp.
