All defined terms used in this Acceptable Use Policy will have the meanings set forth in the Flycrew Platform Terms of Service Agreement (the “Platform Terms”).
Introduction
At Flycrew, our top priority is supporting our users in building and growing their businesses. One of our Core Values is to focus intently on the success of our users. Our Platform serves individuals from all over the world, embracing diverse cultures and supporting content in multiple languages. We want our users to feel empowered to communicate and share their knowledge while ensuring that our Platform remains free of abuse. This Acceptable Use Policy (this “AUP”) outlines what is permitted and what is not on Flycrew.
All users must adhere to this AUP in their use of the Platform and any additional features, communities, or products offered by Flycrew. If you violate this AUP, we may suspend and/or terminate your account, restrict your access to the Platform, remove and/or delete content from your account(s), block all third-party access to content on your account(s), and/or report any violations to impacted third parties or law enforcement authorities (as appropriate and subject to applicable law).
Definitions
If not otherwise defined in this AUP or in the Platform Terms, the following definitions apply:
“Contact” refers to any person you, as a user, may interact with through our Platform, or anyone on your distribution list about whom you have provided us information, or anyone who has otherwise engaged with you via the Platform. For example, if you are a user, a subscriber to your email campaigns or a participant in your courses would be considered a Contact.
“Customers” are your end users, clients, and subscribers.
“User” is how we refer to our customers.
“Platform” encompasses the entire suite of services, products, and offerings provided by Flycrew, made available through our website, https://flycrew.com, and any other website or mobile application owned, operated, or controlled by us, including all insights, analytics, and other features accessible through our products and services. Any new features or tools added to the current offerings will be considered part of the Platform and will also be subject to this AUP.
Legal Compliance
You must use the Platform in accordance with, and only as permitted by, applicable laws. The use of our Platform in conjunction with other tools or resources for any unacceptable purposes described here is also prohibited. We encourage you to seek independent legal counsel to understand the laws applicable to your business and your use of the Platform.
Your Responsibilities
You are responsible for your conduct, content, and communications with others while using the Platform. You must adhere to the following requirements when using the Platform. If we become aware of any conduct or content that violates this AUP, we will take appropriate action, including limiting access, removing content, and/or reporting it, as well as suspending or terminating your account. We may also take steps to prevent uses of our Platform that go against the intent of this AUP.
Unlawful Activities: You may not use the Platform to engage in any unlawful activities, or in activities where use or failure of the Platform could lead to physical harm, death, mental distress, or personal injury.
Age Restrictions: You may not grant access to the Platform or your content to individuals under the age of 16 (or any other restricted age as per local regulations).
Competitive Use: You may not use or access the Platform to build a product or service that competes with Flycrew or for any other competitive purposes.
Operational Interference: You may not misuse the Platform by disrupting its normal operation or attempting to access it through methods other than those provided by Flycrew.
Circumvention: You may not bypass any restrictions imposed on your account (e.g., creating a new account after your previous one was closed for a violation).
Security Testing: Unless authorized by Flycrew in writing, you may not probe, scan, or test the security of the Platform or any Flycrew system or network.
Data Extraction: Unless authorized by Flycrew in writing, you may not use any manual or automated system or software to extract or scrape data from websites or other interfaces provided by our Platform.
Reverse Engineering: You may not deny others access to, reverse engineer, or assist others in reverse engineering the Platform, to the extent permitted by law.
Malware: You may not store or transmit any viruses, malware, or other malicious software through the Platform.
Intellectual Property: You may not use the Platform to infringe upon the intellectual property rights of others.
Reselling: Unless authorized by Flycrew in writing, you may not resell or lease the Platform.
Compliance: If your use of the Platform requires adherence to industry-specific regulations, you will be solely responsible for such compliance, unless Flycrew has agreed otherwise in writing.
Sensitive Information: You may not post or upload content containing personally identifiable information, sensitive personal information, or confidential information without the required consent.
Protected Health Information: You may not use the Platform to collect, store, or process any protected health information subject to HIPAA, health privacy regulations, or other applicable laws.
Email Validity: You must use a valid email address to register an account. Accounts registered using disposable or temporary email addresses, “bots,” or other unauthorized automated methods are prohibited.
Content Use: Flycrew may offer content for use with the Platform (e.g., images or videos provided by third parties). You may use such material solely within your content. Flycrew may modify or revoke that permission at any time.
Excessive Usage: You may not engage in abusive or excessive use of the Platform, which adversely affects the speed, responsiveness, stability, availability, or functionality of the Platform for others. Flycrew will make reasonable efforts to notify you of any excessive usage to allow you to reduce it to an acceptable level.
Recording Compliance: If you use the Platform to record or monitor calls, coaching sessions, or other communications, you must comply with all applicable laws, including securing any required prior consents.
Third-Party Services: You must comply with all acceptable use policies of third-party services used in connection with the Platform (e.g., Stripe, PayPal).
False Information: You may not host or transmit content containing false, inaccurate, or intentionally deceptive information that could harm the public or adversely affect public interest.
Malicious and Deceptive Practices
We are committed to protecting our users from fraudulent, deceptive, or malicious activities. You may not engage in any activities or distribute content that disrupts the Platform or misleads others. Flycrew will suspend and/or terminate any such use, at our discretion, including but not limited to the following:
Sensitive Information Collection: Attempting to collect sensitive information, such as government-issued ID numbers, credit card numbers (beyond authorized payment collection), or passwords.
Unauthorized Sharing: Publishing sensitive identifying information without consent.
Deceptive Practices: Engaging in deceptive practices, such as linking to malicious software.
Scams: Promoting pyramid schemes, multi-level marketing, or other scams.
Clickbait: Hosting content solely for clickbait purposes.
Artificial Boosting: Artificially inflating search engine rankings or social media metrics.
Privacy and Impersonation
Respect for privacy is paramount. You must comply with all applicable data protection laws and regulations regarding any data submitted or collected through our Platform.
Privacy Practices: We encourage you to disclose your privacy practices and require you to adhere to them if disclosed.
Anonymous Claims: You may not claim anonymity if it is not true.
Impersonation: You may not impersonate others while using the Platform.
Cybersquatting
We do not tolerate username extortion. If you register a Flycrew account in someone else’s name with the intention of selling it to them, you are engaging in cybersquatting. Such accounts are subject to immediate cancellation.
Email and Text Message Requirements
Flycrew maintains a zero-tolerance spam policy. We expect our users to treat their customers’ and contacts’ personal information with respect.
Anti-Spam Compliance: You must adhere to all provisions of our Anti-Spam Policy.
Violence and Hateful Content
We may limit or remove content and report it to law enforcement if we believe it poses a genuine risk to public safety or health.
Prohibited Uses: The Platform may not be used to threaten, attack, or incite violence or harassment, nor to promote hate speech or terrorist activities.
Bullying, Harassment, and Criminal Activity
The Platform may not be used to bully, harass, or engage in criminal activities.
Terrorist Organizations
You may not use the Platform to support, promote, or imply association with terrorist organizations.
Child Exploitation
Flycrew has zero tolerance for content that exploits or abuses children.
Pornography and Offensive Material
While certain mature content may be legitimate in context, gratuitous inclusion of graphic material is discouraged.
Content Restrictions: Gratuitous violent or pornographic content is not allowed.
Warning Screens: Content with potential nudity or offensive material should include a conspicuous warning.
Unlawful Content: Unlawful pornography or indecent materials are strictly prohibited.
Intellectual Property Infringement
Flycrew expects all users to respect intellectual property rights. Ensure you have the appropriate rights for any content you use.
Best Practices
To protect our users and our reputation, Flycrew offers resources in our Help Center and encourages users to seek legal counsel regarding compliance.
Flycrew’s Rights
Flycrew is not responsible for, nor does it necessarily endorse, user content or businesses. We may monitor and remove content that violates this AUP or the Platform Terms.
Reporting Violations
If you identify content that violates this AUP, you may file an abuse report at [Flycrew support email]. Please include the URL of the website in question.
Consequences of Violations
Depending on the severity of the violation, Flycrew may respond in various ways, including:
Service Suspension: Temporary suspension of your use of the Platform or specific services until the violation is resolved.
Account Termination: Immediate termination of your account for repeated or severe violations.
