These Terms of Use ("Terms") are an agreement between Generated Media, Inc. ("Generated Media," "we," "our," "us") and you, the user ("you," "your") using our mobile application ("App") to create AI-generated images ("Assets"). These Terms, along with the Privacy Policy and other guidelines, govern your use of the App, the Assets you create using the App, and the images and prompts you provide ("Input," "Inputs").

This Agreement becomes effective when you first access or use the App. We may update the Terms periodically. Your continued use of the App shows that you've accepted any changes. If you disagree with any part of the Terms, please stop using the App.

We continuously enhance the App to improve your experience. As a result, the App, including the style of Assets, the algorithms used to create them, and the features offered, may change over time.

The App is provided "AS IS" without any warranties, express or implied, including, but not limited to, warranties of title, non-infringement, merchantability, or fitness for a particular purpose. You are responsible for evaluating whether the App is appropriate for your use and assuming all risks are involved.

No guarantees are made concerning the Services' quality, stability, uptime, or reliability. We urge you to refrain from creating any dependencies on the App and the Assets. We will not be liable to you or your customers for any liability caused by your dependency on the App.

Generated Media, Inc. reserves the right to suspend or restrict your access to the App anytime for any reason. You are prohibited from using the App to develop or market competing products. You may not reverse-engineer the App or the Assets nor use automated tools to interact with or generate Assets. Reselling or redistributing access to the App is not allowed. Each account is for individual use only.

You may not use the App to infringe on others' intellectual property rights, including copyrights, patents, or trademarks. Violating these rights may result in legal consequences or permanent exclusion from the App.

We reserve the right to investigate any complaints or violations of the Terms and take appropriate action, including reporting unlawful activity to law enforcement or other authorities.

You must be at least 12 years old to use GenYOU. Parental consent may be required if you're under 16, depending on your location. We do not knowingly collect data from anyone under the age of 12. If we become aware of such data, we will delete it immediately.

You confirm that you are at least 12 years old and meet the minimum age of digital consent in your country. If you are old enough to access the App in your country but not old enough to have authority to consent to our Terms, your parent or guardian must agree to our terms on your behalf.

If you are a parent or legal guardian allowing your child or teenager to use the App, you agree to the Terms and are accountable for their activities on the platform.

While we aim to make GenYOU a PG-13 and family-friendly App, the Assets are generated by an AI system in response to your Input. We cannot guarantee their suitability for all purposes.

When you use the App, you may provide us with personal information, such as your email address, technical data, photos you use to train AI models, and prompts you use. Please take a look at our Privacy Policy for more details on how we handle this information.

Ownership of the Assets you create with the App, to the fullest extent allowed by law, is subject to the following conditions:

You are responsible for all Input you provide, including ensuring that it does not violate any applicable laws and the Terms and that you have all necessary rights and permissions to provide the Input.

By using the App, you grant to Generated Media, its affiliates, successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge royalty-free, irrevocable copyright license to reproduce, prepare derivative works of, publicly display and perform, sublicense, and distribute your Input and Assets. This license survives termination of the Terms by any party for any reason.

GenYOU is an open community where others may view and remix your publicly shared Assets. By default, your Assets are viewable and remixable by others. If you want to keep your Assets private, opt for a paid subscription plan.

While GenYOU employs an automated system to monitor and block adult content, it's still possible for some inappropriate content to slip through. While we strive to ensure the safety of our App, it's important to note that AI technology is still evolving, and there may be unforeseen risks or limitations. We continuously monitor and update our systems to address potential issues but cannot guarantee absolute safety. Therefore, we ask that you observe the following basic rules:

If you encounter any Asset that is harmful, offensive, or violates these guidelines and terms, please report it to us immediately using the in-app reporting feature. Your reports help us maintain a safe and positive environment for all users.

We encourage all users to use the App responsibly. Violations may result in bans or restrictions.

We encourage users to report suspicious or harmful activities via the in-app reporting feature. Generated Media Inc. takes these reports seriously and will act to ensure the safety and well-being of all users. Failure to comply with these rules may result in suspending your account, removing any offending content, and potential legal action.

We respect intellectual property rights. If you believe some asset in the App infringes on your copyright or trademark, please contact us at work.with@generated.photos with the subject "Takedown Request" and provide proof of such rights ownership.

Payments for the App are processed through third-party providers. The payment provider's terms will take precedence solely regarding payment processing.

You can cancel your subscription anytime. Please cancel billing at least 24 hours before the subscription renewal date to avoid charges. No refunds are available unless required by law.

We reserve the right to terminate access to the App without refunds for any reason, including violating these Terms.

The App is provided "as is" without guarantees. We are not liable for incidental, indirect, special, or consequential damages, including data loss and privacy breaches.

You agree to indemnify and hold us harmless against any third-party claims resulting from using the App or violating these Terms.

This Agreement and any claim relating to Generated Media, Inc. shall be governed by Delaware, United States laws, excluding conflict of law provisions. In case of a dispute, both parties agree to try to resolve it amicably first. If a resolution cannot be reached, the parties agree to use a private mediator in Delaware, sharing the cost equally. If mediation is unsuccessful, you agree to submit to the jurisdiction and venue of Delaware courts.
