With upcoming changes in EHS law, here is an overview of actions you may want to consider within your operations to prepare for the upcoming legal changes. This isn't an exhaustive list of all changes, rather, we've selected what we think is relevant to the HandsHQ community.
The Health & Safety Information for Employees Regulations 1989
This law requires employers to either display the HSE-approved law poster or provide each of their workers with the equivalent leaflet.
If your business has appointed representatives of employee safety (ROES), it would be good to check whether you have shared this information with those involved. You may also want to check that your unionised workforce (if you have one) understands their H&S responsibilities too.
PPE Regulations
These were under consultation up until 15/8/21. The changes propose that 'limb workers' (aka causal workers) are your employees, and you must owe them rights under the PPE Regs. It would be best to check whether you have any causal workers within your organisation and what extra costs this may amount to
COVID RIDDOR reporting
The HSE website confirmed that work-related COVID events (including dangerous occurrences) are RIDDOR reportable. Further information about RIDDOR is here.
As the government covid winter plans are being released, it is helpful to make sure your workforce is aware of reporting work-related covid incidents promptly to your single point of contact (SPOC) to reduce the chance of a fine or prosecution.
Supply of equipment and PUWER
Since Brexit, there has been a reminder when supplier products to the market that it must come with a declaration of Conformity and user instructions in English, along with being marked with the UKCA conformity marking (CE marking is only valid in the UK until 31 December 2022)
Where you supply products to the market or procuring products, it is vital to check that you comply with this requirement. Further information is available here.
