"Testate" and "intestate" are words used to describe whether a deceased person's estate has a will (testate) or not (intestate). Put differently, a testate estate means that the decedent (deceased person) left a will, which disposes of his or her property. An intestate estate means that the decedent did not leave a will and the relevant state laws will dictate how the deceased person's assets are disposed of.
