HOTEL HIDEAWAY TERMS OF SERVICE
Last updated: October 22, 2026
These Terms of Service apply to new users from the date above. If you already had a Hotel Hideaway Account on that date, they apply to you 30 days after we notify you of them in the game, and until then the terms you previously accepted continue to apply.
For a short version of these Terms of Service click here.
1. About These Terms
The terms of this agreement ("Terms of Service") set out the relationship between you ("you" or "user") and Pocket Worlds Oy ("Pocket Worlds", "Developer" or "we") regarding your use of Developer's Hotel Hideaway game, app, website and related services (together, the "Service"). These Terms of Service, together with the Hotel Hideaway Privacy Policy (the "Privacy Policy") and any other terms specifically referred to in those documents, constitute a legally binding agreement between you and the Developer in relation to your use of the Service and contain important information about your rights and obligations.
Hotel Hideaway was previously operated by Sulake Oy. Pocket Worlds Oy has acquired Hotel Hideaway and is now the provider of the Service. These Terms of Service replace the terms previously offered by Sulake Oy for the Service.
Your use of the Service might also be governed by separate policies, as provided in connection with specific services. If you access the Service via a third-party sign-in service or login, such as Facebook, you are also solely responsible for complying with the terms of service/use and privacy policies associated with such third-party services, in addition to these Terms of Service.
BY DOWNLOADING, INSTALLING, USING OR OTHERWISE ACCESSING THE SERVICE YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND THE PRIVACY POLICY. THE SERVICE IS PROVIDED TO YOU UNDER THESE TERMS OF SERVICE FOR YOUR PERSONAL AND NON-COMMERCIAL USE ONLY. IF YOU DO NOT AGREE TO THE TERMS OF SERVICE OR ANY FUTURE UPDATE MADE TO THEM, YOU DO NOT HAVE PERMISSION TO DOWNLOAD, INSTALL, USE OR OTHERWISE ACCESS THE SERVICE.
SECTION 9 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT APPLY TO UNITED STATES RESIDENTS. PLEASE READ IT CAREFULLY.
You can create an account for the Service ("Account") and become a registered user of the Service by using either an available third-party sign-in service or login or by signing up to the Service directly with us. When you register to use the Service, you will provide us with your email address, and will choose a username and password for your Account. You must ensure that the email address that you provide is, and remains, valid. Your email address and any other information you choose to provide about yourself will be treated in accordance with our Privacy Policy.
Age requirements. The Service is intended for users aged 13 and over. You may not create an Account or use the Service if you are under 13 years old, and we will permanently ban any Account we find belongs to a user under 13. You may not agree to these Terms of Service if you are not legally allowed to do so, or if you are under 18 years old. Users under the age of 18 ("Minor Users") require a parent or legal guardian (a "Guardian") to permit them to use the Service and to agree to these Terms of Service on their behalf. By allowing a Minor User to use the Service, the Guardian becomes subject to these Terms of Service and accepts responsibility for the Minor User's activities on the Service. A Guardian may ask us to close a Minor User's Account by contacting Hideaway Support. Only users aged 18 or over may purchase Virtual Items or make any other real-money transaction in the Service.
Please remember, when accessing the Service over your mobile network, you will be using your data allowance. Please make sure you are aware of the amount of data in your pay-as-you-go or contract allowance. We are not responsible for any charges you may incur in using the Service.
2. License
2.1 Grant of License. Developer grants to you, subject to your acceptance and strict compliance with these Terms of Service (including but not limited to the Acceptable Use section below), a personal, non-exclusive, non-sublicensable, non-transferable, non-assignable, revocable, limited right to use and access the Service for your private and non-commercial purposes. You agree not to use the Service for any other purpose.
2.2 Updates. You understand that the Service is dynamic and for reasons that include, without limitation, system security and stability, Developer may need to automatically update, pre-load, create new versions or otherwise enhance the Service and accordingly, the system requirements to use the Service may change over time. You understand that you are not automatically entitled to future updates, new versions or other enhancements of the Service, although Developer may choose to provide such changes in its sole discretion. All upgrades and updates are provided to you on a license exchange basis. You agree that by using an upgrade or update you voluntarily terminate your right to use any previous version. Developer may license upgrades and updates to you with additional or different terms. You will have no obligation to continue using the Service following any such notification, but you acknowledge that continued use of the Service following any addition, update or amendment constitutes your acceptance of the updated Service. You may need to update third-party software from time to time in order to play Developer's game.
2.3 Ownership. Developer reserves all rights, including without limitation, all intellectual property rights or other proprietary rights, in connection with its games and the Service. The game (including the related software and media) and all other elements of the Service are protected by copyright and other intellectual property laws protecting them from unauthorized use. Developer retains ownership of the game and the copies of the game (if applicable) and all other elements of the Service (including Accounts), and all rights, title and interest in and to the content related to the Service (including without limitation any games, titles, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, documentation, in-game chat transcripts, character profile information, recordings of games played using a game client, and the game clients and server software) are owned by Developer and its licensors.
3. Acceptable Use
3.1 Your Conduct. Any use of the Service in violation of this Acceptable Use section or any other limitation contained in these Terms of Service is strictly prohibited and can result in the immediate revocation of your limited license and may subject you to liability for violations of law. The grant of license in Section 2.1 above is conditional upon your strict compliance with these Terms of Service at any and all times of your use of the Service, including your agreement that you will not, under any circumstances:
Use the Service to upload, post, store, transmit, distribute, make available or otherwise communicate:
any material of any kind that may institute or assist any type of attack, including without limitation distribution of a virus, denial of service attacks upon the Service, or attempts to disrupt the Service or any other person's use or enjoyment of the Service;
any unsolicited or unauthorized advertising or commercial messages, including chain letters, junk or spam email or repetitive messages to anyone;
any information that is abusive, threatening, obscene, indecent, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable or offensive;
any material, the intention of which is to, or attempt to, harass, abuse, or harm, or advocate or incite harassment, abuse, or harm of another person or group, including other users, Developer employees and Developer's customer service representatives;
information that contains nudity, violence, or offensive subject matter or that contains a link to such content; and
any material or information that infringes any copyright, trademark, patent, trade secret, right of privacy, right of publicity, or other right of any person or entity or impersonates any other person, including without limitation a Developer employee.
You also agree that you will not:
Make improper use of Developer's support services or take part in any act that Developer deems to be in conflict with the spirit or intent of the Service;
Disrupt, overburden, or aid or assist in the disruption or overburdening of any computer or server ("Server") used to offer or support the Service or any Developer game environment;
Attempt to gain unauthorized access to the Service, Accounts registered to others or to the computers, Servers, or networks connected to the Service by any means other than the user interface provided by Developer, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that is part of the Service;
Use cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Service, any Developer game or any Developer game experience, or without Developer's express written consent, modify or cause to be modified any files that are a part of the Service or any Developer game;
Attempt to derive the source code for any underlying software or other intellectual property used to provide the Service (including but not limited to attempts to reverse engineer, decompile, disassemble, or otherwise derive the source code), or to obtain any information from the Service, using any method not expressly permitted by Developer; or
Solicit or attempt to solicit personal information from other users of the Service, or collect or post anyone's private information, including personally identifiable information (whether in text, image or video form), identification documents, or financial information through the Service.
You agree to comply with the above conditions at any and all times of your use of the Service, and acknowledge and agree that Developer has the right, in its sole discretion, to terminate your Account or take such other action as we see fit if you breach any of the above conditions or any of the other terms of these Terms of Service. This may include taking court action and/or reporting offending users to the relevant authorities.
3.2 Content Moderation, Notices and Appeals. We use a combination of automated tools and human review to detect and act on content and conduct that breaks these Terms of Service or the law. Actions we may take include removing or restricting content, temporarily muting chat, and suspending or terminating Accounts. Anyone can report content they believe is illegal through the Hotel Hideaway Help page. If we restrict your content or Account, we will tell you, where required by law, what we did and why. You can ask us to review that decision by contacting Hideaway Support within six months of being notified, and a person, not solely an automated system, will review your request. Users in the European Union may also have the right to use a certified out-of-court dispute settlement body. More information is on our Digital Services Act page.
4. Accounts
4.1 Your Account. During the Account creation process, you will be required to select a password ("Login Information"). By using the Service and creating an Account, you agree that:
You will keep your Login Information safe. We strongly discourage letting anyone else access your Account (other than a Guardian in the case of a Minor User). If you do, it is entirely at your own risk;
You are personally responsible for the Login Information and Account and for all of the communication and activity in connection with the Service that results from use of your Account, whether or not you authorized it;
You are solely responsible for the security of your device;
You will not sell, give away or charge others for the right to use your Account, or otherwise transfer your Account;
You will not have more than one Account at any given time;
You will not use the Service if you have previously been removed by Developer, or previously been banned from playing any Developer game;
You will not create an Account using a false identity or information, or on behalf of someone other than yourself;
You accept full responsibility for any unauthorized use of the Service by minors and you are responsible for any use of your credit card or any other payment instrument by minors; and
You will give Developer correct personal and other information necessary for the use of the Service and you will inform Developer of any changes to such information.
4.2 Third-Party Services and Accounts. You may be required to have a valid account on a third-party sign-in service or login through which you access the Service, or a particular feature of the Service. However, the Service is not affiliated with, endorsed, or sponsored by such services, and Developer assumes no liability pertaining to such third-party services. You are solely responsible for complying with the terms of service/use and other policies of third-party services in addition to these Terms of Service. We have no control over third-party services and you agree that we have no responsibility for the actions of third-party service providers. If you access the Service through a third-party sign-in service or login account, you agree that: (a) the information on that account is accurate, current and complete; and (b) you have read and understood the relevant third parties' terms of service/use and other policies.
4.3 Ownership. You understand that all rights in and to the Account are owned by and inure to the benefit of Developer in perpetuity.
4.4 Account Deletion. WE MAY SUSPEND, TERMINATE, MODIFY OR DELETE YOUR ACCOUNT AT ANY TIME FOR ANY REASON OR NO REASON, WITH OR WITHOUT NOTICE TO YOU, SUBJECT TO ANY NOTICE AND REVIEW RIGHTS YOU HAVE UNDER SECTION 3.2 AND APPLICABLE LAW.
You understand that if you delete your Account, or we delete your Account in accordance with these Terms of Service, you may lose access to any data previously associated with your Account (including, without limitation, the level or score you reached and any Virtual Items associated with your Account).
5. Your Content
5.1 User Contributions to the Service. You can contribute to the Service by submitting content you create or contribute to the creation of ("User Content"). User Content includes any communications, images, sounds, and all the material, data, and information that you upload or transmit through the Service, or that other users upload or transmit, including without limitation any chat text.
By transmitting or submitting any User Content, you represent and warrant that:
the User Content is accurate and not confidential;
the User Content does not violate any laws, contractual restrictions or other third-party rights limiting its use, and you have permission from any third party whose personal information or intellectual property is included in the User Content;
you have all necessary authority to grant all of the rights and licenses to Developer under these Terms of Service, and Developer may exercise those rights without incurring any third-party obligations or liability; and
the User Content is free of viruses, adware, spyware, worms or other malicious code.
You acknowledge and agree that any of your personal information within such content will at all times be processed by Developer in accordance with its Privacy Policy. Developer reserves the right in its sole discretion to review, monitor, prohibit, edit, delete, disable access to or otherwise make unavailable any User Content (including without limitation your User Content) at any time, subject to Section 3.2.
Please be aware that any User Content you transmit through the Service may be accessible and viewable by other users. Please do not share any personal information via the Service or any other information that you are not comfortable providing.
5.2 Responsibility for User Content. User Content is the sole responsibility of the user from whom such User Content originated, and you agree that you are solely responsible for any User Content uploaded, posted, transmitted, stored or otherwise made available by you. Developer assumes no responsibility for the conduct of any user submitting any User Content.
5.3 No Obligation to Monitor Content. Developer does not and cannot pre-screen or monitor all User Content. Your use of the Service is at your own risk. By using the Service, you acknowledge and understand that you may be exposed to User Content that is offensive, indecent or otherwise not in line with your expectations. You bear all risks associated with the use of any User Content available in connection with the Service. At our discretion, our representatives or technology provided by our partners may monitor and/or record your interaction with the Service or communications (including without limitation chat text) when you are using the Service, as described in our Privacy Policy. You acknowledge and agree that you have no expectation of privacy concerning the transmission of any User Content, including without limitation chat text or voice communications. Developer shall have the right (but not the obligation) to edit, refuse to post or remove any User Content that fails to comply with these Terms of Service.
5.4 License. You keep any ownership rights you have in your User Content. You grant Developer a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, use, reproduce, adapt, modify, create derivative works of, publish, publicly display, publicly perform and distribute your User Content, in any media, for the purpose of operating, providing, promoting and improving the Service and other Pocket Worlds games and services. This license continues after you stop using the Service for User Content that other users have copied, saved or interacted with, that is part of the shared game world (such as rooms, groups or chats with other users), or that we need to keep for legal reasons. You also grant other users a license to access and interact with your User Content through the Service as the Service allows.
5.5 Moral Rights. To the extent permitted by law, you waive, or agree not to assert, any moral rights you may have in your User Content to the extent needed for Developer to exercise the license in Section 5.4. This does not restrict any rights you have to use and exploit your own User Content.
5.6 Interactions with Other Users. The Service enables users to interact with one another. You are solely responsible for your interactions with other users of the Service and any other parties with whom you interact through the Service. If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, affiliates, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
Developer reserves the right to become involved in any way with these disputes, but is under no obligation to do so. You will fully cooperate with Developer to investigate any suspected unlawful, fraudulent or improper activity, including, without limitation, granting Developer access to any password-protected portions of your Account.
6. Purchases and Payment Terms
6.1 Purchases. The Service may include virtual, in-game currency ("Virtual Currency"), such as credits, coins, cash, or points, and virtual, in-game digital items ("Virtual Goods") such as clothing, diamonds or accessories that may be purchased with "real world" money. Virtual Currency may also be used to purchase Virtual Goods (Virtual Goods together with Virtual Currency, "Virtual Items"). You agree that once purchased, Virtual Items have no monetary value and cannot be exchanged for real goods/services or for real money from us or anyone else. You must be 18 or older to purchase Virtual Items.
You understand that you do not own Virtual Items but instead you purchase a limited, non-exclusive, personal, non-transferable, non-sublicensable, revocable license to use the Virtual Items as part of the Service under these Terms of Service. We reserve the right to control, change, regulate or remove any Virtual Items without any liability to you or any third party.
The transfer of Virtual Items is prohibited except where expressly authorized. Other than as expressly authorized in the Service, you shall not sell, redeem or otherwise transfer Virtual Items to any person or entity, including but not limited to Developer, another user or any third party. You also agree that you will only obtain Virtual Items from us, and not from any third party.
Virtual Items you purchased or earned before Pocket Worlds Oy took over the Service remain associated with your Account and continue to be governed by these Terms of Service.
6.2 Payment. You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. Developer may revise the pricing of Virtual Items and/or any other goods and services offered through the Service at any time. All purchases made through the Service are final and non-refundable, except as required by applicable law. The provision of Virtual Items for use in the Service is a service provided by Developer that commences immediately upon acceptance by Developer of your purchase. Virtual Items purchased through other platforms such as Apple iOS, Google Play or Steam will be subject to those platforms' payment terms and conditions. Please review the relevant platforms' terms of service for further information.
YOU AGREE AND ACKNOWLEDGE THAT, EXCEPT AS REQUIRED BY APPLICABLE LAW, DEVELOPER IS NOT REQUIRED TO PROVIDE A REFUND OF ANY FEE FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.
YOU MUST HAVE THE BILL-PAYER'S PERMISSION BEFORE YOU PURCHASE ANY VIRTUAL ITEMS THROUGH THE SERVICE. You are able to protect your Apple iOS account from unintentional or unauthorized purchases. Please follow https://support.apple.com/en-gb/HT204396 for more information. We reserve the right to refuse to permit minors to use the Service at our discretion.
6.3 How It Works. In respect of Virtual Items, your order is an offer to the Developer to purchase a license (as described in Section 6.1 above) to use Virtual Items on the Service. This order will be accepted by us when we credit the Virtual Items to your Account, or debit the account through which you paid, whichever occurs first.
If you are a consumer living in the European Union, you have a period of 14 days to withdraw from distance contracts for the purchase of digital content. However, you acknowledge and understand that when you purchase a license to use Virtual Items from us, you:
Expressly consent to the immediate supply of Virtual Items; and
Acknowledge that your right of withdrawal under the European Union's Consumer Rights Directive (as implemented in your jurisdiction) is lost once you receive the Virtual Items.
6.4 Ownership. Developer retains ownership of the game and the copies of the game (if applicable) and all other elements of the Service (including Accounts) and all rights, title and interest in and to the content related to the Service. You acknowledge that you have no right or title in or to any content related to the Service, including without limitation the Virtual Items appearing or originating in the Service, whether earned by utilizing the Service or purchased, or any other attributes associated with an Account or stored in the Service. Accordingly, you have no other interest, including no property, proprietary, intellectual property, ownership, or monetary interest, in your Virtual Items, which remain in Developer's ownership.
6.5 Memberships and Subscriptions. If you buy a VIP membership or any other subscription that renews automatically, you agree that it will renew at the end of each period and that you will be charged the then-current price through the platform you bought it on, until you cancel. We will notify you of any price increases or changes to the subscription terms by any reasonable means, including a message in the game. You can cancel at any time through the subscription settings of the app store or platform you bought it on. If you cancel, you keep the membership benefits for the rest of the period you already paid for.
7. Disclaimer of Warranties, Limitation of Liability and Indemnification
7.1 DISCLAIMER OF WARRANTIES. SUBJECT TO THE REMAINDER OF THIS SECTION 7.1, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, MISAPPROPRIATION OF INTELLECTUAL PROPERTY RIGHTS OF THIRD PARTIES, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Developer does not warrant or make any representations, conditions or other terms of any kind regarding, including but not limited to:
The Service and its functions, features, and elements;
Any products or services offered or referenced at or linked through the Service;
The security associated with the transmission of your User Content to or via the Service;
The ability to access or use the Service at the times or locations of your choosing;
That the Service will be uninterrupted or error-free;
That defects will be corrected; or
That the Service is free of viruses or other harmful components.
If you are a consumer residing in the European Union or the United Kingdom, you are entitled to various statutory warranties (including, for example, that any service is carried out with reasonable skill and care, and any digital content provided is of satisfactory quality). Nothing in these Terms of Service shall have the effect of excluding or limiting those statutory warranties which may not be excluded or limited under applicable law.
7.2 LIMITATION OF LIABILITY.
No Consequential Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DEVELOPER, ITS AFFILIATES, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS OR SERVICE PROVIDERS (THE "AFFILIATED PARTIES") BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR ANY OTHER INTANGIBLE LOSS) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE OR ANY MATERIALS OR CONTENT ON THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT DEVELOPER HAS BEEN INFORMED OF THE POSSIBILITY OF DAMAGE.
Cap. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF DEVELOPER AND THE AFFILIATED PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PART OF THE SERVICE OR OTHERWISE UNDER THESE TERMS OF SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO US $1,000 (EXCEPT AS NOTED IN SECTION 9.3).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above disclaimers and limitations may not apply to you. To the extent that Developer may not, as a matter of applicable law, disclaim any warranty or limit its liability as set forth herein, the scope of such warranty and the extent of Developer's liability shall be the minimum permitted under such applicable law.
In particular, nothing in these Terms of Service shall affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from any negligence or fraud of Developer.
Notwithstanding the foregoing, the following will apply for consumers resident in the European Union or the United Kingdom:
If we do not comply with our obligations to you under these Terms of Service or are negligent in providing the Service to you, we are responsible for any loss or damage that you suffer that was a "foreseeable result" of such breach or negligence. Loss or damage is a foreseeable result if it is an obvious consequence of our failure to comply with these Terms of Service or if it was contemplated by you and us at the time we entered into the contract;
If you purchase digital content through the Service that is faulty, you are entitled to request that it is repaired or replaced;
If the fault cannot be fixed within a reasonable time, you may be entitled to receive a full or partial refund of any fees paid (if any) for the content; and
If you can demonstrate that the fault has damaged your device and the Developer has not used reasonable skill and care, then you may be entitled to a repair or to compensation.
We will do our best to make sure that the Service is uninterrupted and error-free, although we cannot guarantee this. If we need to suspend or restrict access to, or update, the Service, we will do our best to minimize any disruption to users. We recommend that users install virus protection software on any devices they use to access the Service.
7.3 Indemnification. You shall defend, indemnify and hold harmless Developer, its affiliates, licensors, partners and subcontractors from all liabilities, claims and expenses, including reasonable legal fees, asserted by any third party resulting from, arising from or related to your use of the Service, your breach of these Terms of Service, or any act or omission by you relating to the Service (including the above warranties and representations relating to User Content). Developer reserves the right to assume its own defense and/or control of any matter otherwise subject to indemnification by you hereunder.
8. Suspension and Termination of Account and Service
8.1 Developer's Right to Terminate. Without limiting any other remedies, Developer may, at its sole discretion, limit, suspend, terminate, modify, or delete Accounts or access to the Service or portions thereof if you fail, or if Developer suspects such failure, to comply with any of these Terms of Service or for any actual or suspected illegal or improper use of the Service, with or without notice to you, subject to Section 3.2. You can lose your username and persona as a result of Account termination, limitation or a claim by a third party, as well as any benefits, privileges, earned items and purchased items, and Developer is under no obligation whatsoever to compensate you for any such losses or results.
Without limiting our other remedies, Developer may limit, suspend or terminate the Service and user Accounts or portions thereof, prohibit access to our game and website, and their content, services and tools, delay or remove hosted content, and take technical and legal steps to prevent users from accessing the Service if we believe that they are creating risk or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with the letter or spirit of our terms or policies. Additionally, we may, in appropriate circumstances and at our sole discretion, suspend or terminate Accounts of users who may be repeat infringers of third-party intellectual property rights.
Developer reserves the right to stop offering and/or supporting the Service or part of the Service at any time with or without notice to you, at which point your license will be automatically terminated. In such event, Developer shall not be required to provide refunds, benefits or other compensation to users in connection with such discontinued Service, except as required by applicable law. Termination of your Account can include disabling your access to the Service or any part thereof, including any content you or others submitted.
8.2 Your Right to Terminate. You may terminate your Account at any time and for any reason by using the "Delete account" option in the game settings or by contacting us at the email address provided at the end of these Terms of Service.
9. Dispute Resolution, Class Action Waiver, Arbitration, and Governing Law
9.1 Disputes. Except as described below, you and Developer agree that any dispute arising under or relating to these Terms of Service, the Privacy Policy or the Service ("Dispute") will be resolved first through the Informal Dispute Resolution Requirements in Section 9.2, and only if those requirements are satisfied, then, for United States residents only, through binding arbitration and not through litigation. This agreement applies irrespective of the legal theories involved in the Dispute and regardless of whether the Dispute is with Developer, its affiliates, any suppliers or service providers involved with the Service, or their officers, directors, employees, agents, or successors. IF YOU ARE A UNITED STATES RESIDENT, YOU AGREE TO GIVE UP THE RIGHT TO FILE A LAWSUIT IN COURT BEFORE A JUDGE OR JURY, INCLUDING IN A CLASS ACTION, FOR DISPUTES THAT ARE SUBJECT TO ARBITRATION.
Class Action Waiver. To the extent permitted by law, you and Developer agree that neither party will assert a claim against the other in a class action, class arbitration, or in any other similar representative capacity. This class action waiver does not prohibit you and Developer from resolving Disputes through a class settlement approved by a court.
9.2 Informal Dispute Resolution Requirements.
Informal Discussion Period. For a period of at least 60 days before starting any arbitration (or lawsuit, if an exception to arbitration applies), you and Developer agree to first engage in informal discussions to attempt to negotiate a resolution of any Dispute. These informal discussions must include live verbal conversations by telephone or other device if requested by either party. These informal discussions will start ten days after written notice is sent from you to Developer or from Developer to you. These informal discussions must be concluded either by a resolution agreed to in writing by the parties or by written notice from one party sent 7 to 10 days before the end of the 60-day informal dispute resolution period, explicitly stating each unresolved demand and its basis.
Notices. Developer will send you notices to the email address or billing address you provided. You will send notices to Developer at the postal address in Section 14 by certified mail or by courier (such as Federal Express or an international equivalent), with a copy by email to contact@pocketworlds.com. The initial notice of a Dispute from you must include: (a) your full legal name, (b) the username of your Hotel Hideaway Account, (c) the email address associated with your Account, if any, (d) a description of the nature and basis of the claim, (e) the specific result desired, and (f) the ticket or case number provided by Hideaway Support to track previous attempts to resolve the Dispute, if there is one.
9.3 Arbitration Terms (United States Residents).
Arbitrable Disputes. Except as explained below, Developer and any user who is a United States resident agree that any Dispute that has satisfied the Informal Dispute Resolution Requirements will be subject only to binding arbitration by a neutral arbitrator and may not be litigated. The arbitrator's decision will be final, except for a limited right of appeal allowed by federal law. The arbitrator may award you damages, just like a court could, but only to the extent necessary to satisfy your individual claim.
Arbitration Rules. Arbitration will be overseen by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules ("AAA Rules"). You can find more information at www.adr.org.
Mandatory Prerequisite to Arbitration or Litigation. No Dispute will be subject to arbitration (or to a lawsuit if an exception to arbitration applies) unless the Informal Dispute Resolution Requirements have been satisfied by the party demanding arbitration (or the party filing the lawsuit if an exception to arbitration applies). AAA shall not accept disputes submitted to arbitration in violation of the Informal Dispute Resolution Requirements, and such disputes shall be deemed frivolous for purposes of any fee-shifting allowed by AAA Rules. Any lawsuit filed in violation of the Informal Dispute Resolution Requirements shall be subject to dismissal.
Commencement of Arbitration. Unless the parties agree otherwise, a demand for arbitration must be sent to the same address and in the same manner as an initial notice of a Dispute and must be entitled "Demand for Arbitration."
Fees. If you have complied with the Informal Dispute Resolution Requirements, and if your total claims are for less than $10,000, Developer will reimburse your filing fee, unless the arbitrator determines that the substance of your claims or the remedy sought were frivolous or brought for an improper purpose as described in the AAA Rules, in which case AAA Rules will decide payment of any filing, administrative, or arbitrator fees. Notwithstanding any contrary provision in these Terms of Service, a prevailing party in arbitration will only be entitled to be awarded a shifting of fees and costs when consistent with AAA Rules.
Location. Unless the parties agree otherwise, any arbitration hearing will take place in Bexar County, Texas, if that is a reasonably convenient location for you, and if not, then in the county or parish where you reside. Depending on the amount of a claim, AAA Rules may permit or require the arbitration to be conducted: (1) only by documents submitted to the arbitrator; or (2) by telephone hearing. Regardless of how arbitration is conducted, the arbitrator must issue a written decision explaining the findings and conclusions on which the decision is based.
Settlement Offers. During arbitration, if Developer makes you (or you make Developer) a settlement offer, the amount of the offer may not be shared with the arbitrator until after the arbitrator makes a final decision and award. If you win the arbitration and are awarded more than the amount in Developer's last written settlement offer, Developer will pay you the higher of: (a) the arbitrator's award or (b) $10,000.
No Consolidation. To the extent permitted by law, the arbitrator shall not consolidate claims into a class proceeding and may award injunctive relief only in favor of the individual parties to the arbitration and only to the extent necessary to provide relief warranted by an individual claim.
Enforceability. All issues in the Dispute are for the arbitrator to decide, except that only a court may decide issues relating to the scope, interpretation, and enforceability of these Arbitration Terms, or whether a Dispute can be arbitrated. Judgment on an arbitration award may be entered by any court having jurisdiction.
Severability. Except for the Class Action Waiver, if any provision of these Arbitration Terms is found unenforceable, that provision will be severed and the balance of these Arbitration Terms will remain in full force and effect. If a court decides that applicable law precludes enforcement of these Arbitration Terms as to any particular claim for relief or remedy (such as declaratory or injunctive relief), then that claim or remedy (and only that claim or remedy) must be severed from the arbitration, while the remaining claims and remedies (such as individual damages or restitution) will still be resolved through binding arbitration.
Confidentiality. The arbitrator shall honor all evidentiary privileges recognized at law and shall enter orders as appropriate to protect the parties' trade secrets or confidential information. The parties agree to maintain the confidentiality of each party's designated confidential information.
9.4 Exceptions.
Exceptions to Informal Dispute Resolution Requirements and Arbitration Terms. The following claims and actions are exempt from both the Informal Dispute Resolution Requirements and the Arbitration Terms: (i) enforcement actions through a federal, state, or local agency if those actions are available; (ii) claims for infringement of patent, copyright, trademark, or trade secret rights; (iii) actions seeking only injunctive relief and no award of attorneys' fees or costs; and (iv) actions seeking remedies under the GDPR.
Exceptions to Arbitration Terms. Individual non-class claims that you or Developer elect to assert in small claims court are not subject to the Arbitration Terms, but the Informal Dispute Resolution Requirements must be satisfied before filing any such small claims action. Additionally, claims that are the subject of a certified class action or a class settlement submitted to a court for approval, regardless of whether the claimant has opted out of the class action or class settlement, are not subject to the Arbitration Terms and may not be the subject of an arbitration demand. Regardless of whether you have opted out of a class action or class settlement, the certification of a class action or the filing of a proposed class settlement with a court for approval shall divest AAA of its authority to arbitrate any claims pending with AAA that are otherwise the subject of the class action or settlement. Such opt-out claims may thereafter only be asserted in a court of law.
9.5 Opting Out of Arbitration Terms. You may opt out of the Arbitration Terms within 30 days of first accepting these Terms of Service, and you may opt out of any material changes to the Arbitration Terms within 30 days after Developer gives notice of those changes (unless a longer period is required by applicable law). To opt out, you must send a notice titled "Arbitration Opt-Out Notice" to the postal address in Section 14 by certified mail or by courier (or international equivalent). The Arbitration Opt-Out Notice must include: (a) your full legal name, (b) the username of your Hotel Hideaway Account, and (c) your email address. An opt-out notice does not revoke or otherwise affect any previous agreement to the Arbitration Terms. By opting out of a change to the Arbitration Terms, you agree to arbitrate any Dispute in accordance with the language of the last Arbitration Terms that you accepted.
9.6 Governing Law and Venue. These Terms of Service are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. The Arbitration Terms are subject to and governed by the Federal Arbitration Act ("FAA") and (only to the extent not inconsistent with the substantive and procedural provisions of the FAA) the laws of the State of Texas, without regard to conflict of law principles. Rulings in other related arbitrations will not bind the arbitrator. Any Disputes that are not subject to the Arbitration Terms or that are severed from any arbitration may only be litigated in the federal or state courts of Bexar County, Texas, and the parties consent to personal and exclusive jurisdiction in these courts, except as otherwise provided by the GDPR or by Section 9.7.
9.7 Consumers Outside the United States. If you are a consumer resident in the European Union, the European Economic Area, the United Kingdom or another country whose laws give consumers mandatory protections, the choice of Texas law above does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings relating to these Terms of Service in the courts of your country of residence. The arbitration and class action waiver provisions in Sections 9.1 and 9.3 do not apply to you unless you are a United States resident.
10. Copyright and Trademark
10.1 Copyright Notices. We respect the intellectual property rights of others and ask you to do the same. If you are a copyright owner or an agent of a copyright owner and believe that any content on the Service infringes your copyright, you may submit a notification under the Digital Millennium Copyright Act ("DMCA") by contacting our Copyright Agent at copyright_agent@pocketworlds.com or at the postal address in Section 14, marked "Attention: Copyright Agent". If you fail to comply with all of the requirements of this section, your notice may not be valid. You must provide the following information in writing (see 17 U.S.C. 512(c)(3) for further detail):
an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other right being infringed;
a description of the copyright-protected work or other intellectual property right that you claim has been infringed;
a description of the material that you claim is infringing and where it is located;
your address, telephone number, and email address;
a statement by you that you have a good faith belief that the use of those materials is not authorized by the copyright owner, its agent, or the law; and
a statement by you that the information in your notice is accurate and that, under penalty of perjury, you are the copyright or intellectual property owner or authorized to act on the owner's behalf.
You can also report content you believe infringes your rights through the notice mechanism described in Section 3.2.
10.2 Counter-Notice. If content you posted was removed or disabled and you believe that it is not infringing, or that you have authorization from the copyright owner, the copyright owner's agent, or the law to post and use it, you may send a counter-notice to our Copyright Agent. A Guardian must submit any counter-notice on behalf of a Minor User. When our Copyright Agent receives a counter-notice, we may send a copy of it to the original complaining party, informing them that we may replace the removed content or stop disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the provider of the content, the removed content may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at our sole discretion.
10.3 Repeat Infringer Policy. Our intellectual property policy is to: (i) remove or disable access to material that we know infringes the intellectual property rights of third parties or that has been identified in a valid DMCA notice; and (ii) in appropriate circumstances, terminate the Accounts of, and block access to the Service by, any user who repeatedly or egregiously infringes other people's copyrights or other intellectual property rights.
10.4 Trademarks. You may not post User Content that infringes trademarks, and we may block or remove User Content that does. If you are a trademark owner and believe your trademark is being infringed on the Service, contact our Trademark Agent at copyright_agent@pocketworlds.com or at the postal address in Section 14, marked "Attention: Trademark Agent". We are not in a position to mediate disputes between users and trademark owners, but we will look into and try to resolve any allegations of trademark infringement. Please provide the same information listed in Section 10.1, referring to your trademark instead of a copyright.
11. Apple Notice
If you use the Hotel Hideaway app on an iOS device, you also acknowledge and agree to the terms of this section. These Terms of Service are between you and Developer only, not with Apple, and Apple is not responsible for the Service or its content. Apple has no obligation whatsoever to provide any maintenance and support services with respect to the Service. If the Service fails to meet any applicable warranty, you may notify Apple, and Apple will refund any applicable purchase price for the app to you. Apple has no other warranty obligation whatsoever concerning the Service. Apple is not responsible for addressing any claims by you or any third party relating to the Service or your use of it, including: (a) product liability claims; (b) any claim that the Service fails to meet any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the Service or your use of the app infringes that third party's intellectual property rights. You agree to comply with any applicable third-party terms when using the Service. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms of Service, and when you accept these Terms of Service, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
12. Notice to California Residents
12.1 Complaints. If you are a California resident, in accordance with California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. Market Blvd., Suite S-202, Sacramento, CA 95834 or by phone at (800) 952-5210 to resolve complaints regarding the Service or to obtain more information about the use of the Service.
12.2 Minors. If you are a California resident under the age of 18, you may ask us to remove specific personal content that you have publicly posted on the Service, and we will do so as required by law. To make a request, contact Hideaway Support with your username and a detailed description of the content you want removed so that we can locate it. We will not accept requests by postal mail, phone, or fax, and may be unable to respond if you provide incomplete information. Making a request does not guarantee that the content will be completely removed, and there may be circumstances in which the law does not require or allow removal.
13. General
13.1 Additional Policies. Developer may publish additional policies related to specific services such as forums, contests or loyalty programs. Your right to use such services is subject to those specific policies and these Terms of Service.
13.2 Severability. If any part of these Terms of Service is held invalid or unenforceable, that part will be given the maximum effect possible (or, if it cannot be given any legal effect, will be severed), and the remaining parts will remain in full force and effect.
13.3 Assignment. Developer may assign or delegate these Terms of Service and/or the Privacy Policy, in whole or in part, to any person or entity at any time without your consent. You may not assign or delegate rights or obligations under these Terms of Service or the Privacy Policy, by operation of law or otherwise, without Developer's prior written consent. These Terms of Service are binding on and benefit Developer's and your respective successors and assigns.
13.4 Entire Agreement. These Terms of Service, any additional policies of Developer and any documents expressly incorporated by reference herein (including the Privacy Policy) set out the entire agreement between you and us concerning the Service and replace all earlier agreements and understandings between you and us, or between you and Sulake Oy, concerning the Service.
13.5 Notice. Developer may notify users via postings on the Service or website, via email, or via any other communication means using the contact information provided to us. All notices given to Developer shall be in writing and addressed to the address in Section 14. Any notices to Developer that do not comply with this section shall not be valid.
13.6 Consent to Electronic Communications. By using the Service, you agree to receive electronic communications from us as described in the Privacy Policy. You agree that any electronic notices, agreements, or other messages we send you satisfy any legal requirement that such communications be in writing.
13.7 No Waiver. The failure of Developer to require or enforce strict performance by you of any provision of these Terms of Service or the Privacy Policy, or failure to exercise any right under them, shall not be construed as a waiver or relinquishment of Developer's right to assert or rely upon any such provision or right in that or any other instance. The express waiver by Developer of any provision, condition, or requirement of these Terms of Service or the Privacy Policy shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.
13.8 Force Majeure. Developer shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of Developer, including without limitation any failure to perform hereunder due to unforeseen circumstances or causes beyond Developer's control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
13.9 Changes to These Terms of Service. We will give you reasonable advance notice of any significant changes to these Terms of Service, by any reasonable means, including a notice in the game or on the Service Website. Non-material changes (as determined by Developer), and changes made for legal reasons or to address new features of the Service, take effect immediately without notice. If you do not agree to any change, you should stop using the Service. If you continue to use the Service after the changes take effect, you agree to the updated terms. Any Disputes covered by these Terms of Service will be handled in accordance with Section 9.
13.10 Compatibility. Although we are working to ensure that the Service is compatible across various devices, we cannot guarantee that it will work on all devices, and it is your responsibility to ensure that you are able to comply with the relevant system requirements as described by us. Your use of the Service and enjoyment of its features and content may vary in functionality, availability and quality depending on the type of device you use.
13.11 Compliance with Laws. When using the Service, you will comply with all applicable laws. You will not directly or indirectly export, re-export, or transfer the Service to prohibited countries or individuals, or allow either to use the Service.
13.12 Time Limit for Claims. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND DEVELOPER AGREE THAT ANY CAUSE OF ACTION ARISING FROM OR RELATED TO THE SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES OR IT IS PERMANENTLY BARRED.
13.13 Survival. Any part of these Terms of Service that, by its nature, should survive termination will survive termination, including Sections 2.3, 3, 4.3, 5, 6.4, 7, 9, 10, 13 and 14.
13.14 Interpretation. Section headings are for convenience only and do not affect the interpretation of these Terms of Service. Wherever Developer is allowed to make a decision under these Terms of Service, that decision is within Developer's discretion. These Terms of Service apply except to the extent otherwise prohibited or required by applicable law. Unless the context requires otherwise, "including" means "including, without limitation", and "or" means "and/or".
13.15 Third-Party Beneficiaries. Nothing in these Terms of Service grants any rights or benefits to a third party, other than Apple as described in Section 11.
13.16 Prevailing Language. These Terms of Service may be available in multiple languages. If there is any discrepancy or conflict between the English version and any other language version, the English version governs and prevails, except where applicable law requires otherwise.
