Welcome to the Inevitable Audio Series Platform (“Platform”), operated by EVEN Labs Inc. (“EVEN,” “we,” “us,” or “our”) in collaboration with J. Cole. Protecting your privacy is important to us. This Privacy Policy explains how we collect, use, share, and protect your personal information. By using the Platform, you agree to the terms outlined below.


1. Information We Collect

We collect the following types of information to enhance your experience on the Platform:

Personal Information Provided by You

  • Account Information: When you create an account, we collect your name, email address, and phone number.

  • Payment Information: All payments are processed through Stripe. We do not store your payment information.

  • Marketing Preferences: With your explicit consent, we collect preferences for receiving marketing communications.

Automatically Collected Information

  • Device and Usage Data: We collect data such as your IP address, device type, operating system, browser type, and usage patterns through cookies and similar technologies.

We collect non-identifiable information, as necessary to provide the Platform to you, as well as for internal evaluation and enhancement of our Platform.

We collect most of your information directly from you through your use of the Platform. However, we may also collect information:

  • Directly from a third party (e.g., screening or due diligence providers, service providers, and business partners);

  • From a third party with your consent;

  • From cookies, web beacons, geographical location tracking features (“geo-fencing”), and other tracking technologies; and

  • Automated monitoring of our Platform and other technical systems, such as our computer networks and connections, communications systems, email and messaging systems.

We may ask you to provide certain personal information such as your name, phone number, and email address when register for an account on our Platform. In addition, if you are providing personal information for a third party in connection with using our Platform, you are responsible for ensuring that you have all required permissions and consents to provide such personal information to us for use in connection with the Platform and that our use of such personal information to provide the Platform does not violate any applicable law, rule, regulation or order.

We may automatically collect the following information about your use of our Platform through cookies and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our site and or use of our services; and the referring URL, or the webpage that led you to our Platform. We may combine this information with other information that we have collected about you, including, where applicable, your name, and other personal information. Other parties may indirectly or directly give us information about you. These other parties might include analytics providers, social media platforms, or other third parties that provide us with information they have collected either directly or indirectly from you.

  • To provide our Platform and/or to review and update our Platform;

  • To comply with our legal and regulatory obligations, including in fulfillment of our anti-money laundering regulatory obligations;

  • For the performance of our relationship with you;

  • For our legitimate interests or those of a third party; and

To the extent we rely on our legitimate interests as a legal basis for processing of your personal information, we have considered the balance between our own interests (among other things, the lawful and efficient operation of our Platform) and your interests and we believe that (a) you would reasonably expect us to carry out the kind of processing referenced above and (b) such processing will not cause you any harm and/or will not seriously impact your rights and freedoms with regard to data privacy. You have the right to withdraw any consent given to us for the processing of your personal information.

We do not sell your personal information. We may share your information in the following ways:


With Service Providers

We share your data with third-party service providers to operate the Platform:

  • Authentication: Magic for secure login services.

  • Payment Processing: Stripe for handling transactions.

  • Analytics: Google Analytics for usage analysis.

Each service provider has access only to the personal information necessary to perform their functions and must process it in accordance with this Privacy Policy.

As Required by Law

We may disclose your information to comply with legal obligations or respond to lawful requests by public authorities.

Business Transfers

In the event of a merger, acquisition, or asset sale, your personal information may be transferred.


Promotional Communications

We may use your personal information to send you updates (by email, text message, telephone or mail) about our Platform, including exclusive offers, promotions or new products or services. We have a legitimate interest in processing your personal information for promotional purposes. This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly. Your Rights Under the GDPR. If you are an EU or UK resident, you are entitled to certain rights under the GDPR and UK GDPR with respect to personal information that we have collected. We have listed below how these rights operate in the context of using our Platform.

The right to require us to correct any mistakes in your personal information

The right to require us to delete your personal information - in certain situations

Your Rights In California.

“Shine the Light”: Under California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), California residents who provide us certain personal information are entitled to request and obtain from us, free of charge, information about the personal information (if any) we have shared with third parties during the immediately preceding calendar year for their own direct marketing use. Such requests may be made once per calendar year for information about any relevant third-party sharing in the prior calendar year. California residents who would like to make such a request may submit a request via the contact information provided below. The request should attest to the fact that the requester is a California resident and provide a current California address. We are only required to respond to a customer request once during any calendar year. Please be aware that not all information sharing is covered by California’s “Shine the Light” law and only information sharing that is covered will be included in our response.


Do-Not-Track Disclosures: We do not support Do Not Track (“DNT”) requests. Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.


Your Rights In Nevada. If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. You can exercise this right by contacting us here. Please note that we do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A. We use industry-standard measures to protect your personal information, including:

8. Cookies and Similar Technologies

Our Use of Cookies and Other Tracking Mechanisms: We and our third party service providers use cookies and other tracking mechanisms to track information about your use of our Platform. We may combine this information with other personal information we collect from you (and our third party service providers may do so on our behalf).


Cookies: A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Platform. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Platform.


Performance and Analytics Cookies: These cookies allow us to count visits and traffic sources, through various third parties, so we can measure and improve the performance of our Platform. These enable us to collect information about how you use our Platform or read our publications, for instance which pages are viewed by visitors most frequently and how users interact with each of our Platform. This information is used to compile reports to improve the respective site, including reports on the number of visitors to the Platform, where the visitors are located, marketing and referrals, and what pages the users visit on the Platform. All information these cookies collect is aggregated and is not associated with an identifiable individual. If you do not allow these cookies, we will not know when you have visited our Platform and will not be able to monitor site performance.


Web Beacons: Pages of our the Platform and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).


Pixel Tags: Pixel tags are tiny graphic images with a unique identifier, similar in function to cookies, that are used to track online movements of web users. In contrast to cookies, which are stored on a computer’s hard drive or web browser, pixel tags are embedded invisibly in web pages. Pixel tags are often used in combination with cookies, to trigger the placing of cookies, and/or to transmit information to us or our vendors or partners. This enables two websites to share information. The resulting connection can include information such as a device’s IP address, the time a person viewed the pixel, an identifier associated with a browser or device, the type of browser being used, and the URL of the web page from which the pixel was viewed. Pixel tags also allow us to send email messages in a format that users can read, tell us whether emails have been opened, and help to ensure we are sending only messages that may be of interest to our consumers.


Most browsers automatically accept cookies, but you may be able to control the way in which your devices permit the use of cookies, web beacons/clear gifs, and other automatic data collection technologies. If you so choose, you may block or delete our cookies from your browser; however, blocking or deleting cookies may cause some Platform features and general functionality to work incorrectly.

9. Third-Party Links

The Platform may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies.

10. Children's Privacy

Children: Our Platform is not intended or directed to children under the age of 18, and we do not knowingly solicit, collect, use, or disclose personal information from children under the age of 18. If you are under 18, do not use or provide any information on this Platform, make any purchases through the Platform, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we become aware that a child has provided us with personal information in violation of applicable law, we will delete any personal information we have collected, unless we have a legal obligation to keep it. If you believe we might have any information from or about a child under 18, please contact us.


Changes to This Privacy Policy: We may change this Privacy Policy from time to time, so please be sure to check back periodically. When we do, we will post any changes to this Privacy Policy on the Platform.


11. International Data Transfers

We may transfer your personal information to a third party that is located in a jurisdiction other than the one from which we collected your personal information, including to countries that have not been deemed to have an adequate level of protection for the rights and freedoms of data subjects. If we do transfer your personal information to another jurisdiction, we will do so following due diligence and provided that the data recipient is subject to contractual agreements imposing obligations on it to ensure appropriate technical and organization measures are implemented and maintained at all times to prevent the unauthorized and unlawful processing of personal information, and the accidental loss or destruction of, or damage to, personal information, consistent with our obligations under applicable data protection laws.

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal reasons. We will notify you of significant changes by:

  • Posting the revised policy on the Platform.

  • Updating the "Last Updated" date above.

  • Providing advance notice via email or a prominent notice on the Platform.

Your continued use of the Platform after such changes constitutes your acceptance of the updated Privacy Policy.

This Privacy Policy is governed by the laws of the State of New York, without regard to its conflict of law principles.
