What guarantee forms do we have on Landlord Law and where can they be found?

When renting property to tenants it is often advisable to take a guarantee, preferably from a property owing relative or associate of the tenant.  This gives you some financial protection if your tenants fail to pay their rent.

Guarantees are typically taken in the following situations:

  • For student lets

  • Where referencing has shown that tenants may struggle to pay the rent, and

  • For company lets, from one or more directors of the company

On Landlord Law, for our English members there are three kinds of guarantee:

1 Guarantees incorporated into tenancy agreements

When creating any of our tenancy agreements (using our Document Generator) you can select to have our special guarantor clauses included in your tenancy agreement.  
This is often the best solution where there is going to be just one or two guarantors as it reduces the amount of paperwork!

So for this option you will need the tenancy agreements page.

2 Stand alone guarantees - our standard guarantee

However for some tenancies, in particular student lets where several students will be sharing and signing the same tenancy agreement, it could cause problems if multiple people are to sign the same document.

In this case it is best to our a stand alone form of guarantee.  Landlord Law members will find this on the Tenancy Agreement Additional Forms page.

3 The 'Guarantor friendly' guarantee form.

Sometimes guarantors are unhappy with the standard guarantee form as they will potentially become liable for damage caused (in student lets for example) by any of the students.  Rather than just the damage done by (for example) their own son or  daughter.

To help with this we have an alternative form of guarantee which limits the liability of the guarantor.  Most landlords will be unhappy about using this however as it will limit their ability to make full recovery of losses.

For Welsh Properties:

For Welsh members, we have just the two stand-alone guarantees. The Welsh occupation contracts are so long already that we are reluctant to make them any longer!
