To proceed with a Motor Legal Protection claim, there must be a reasonable chance of success—this means a 51% or higher likelihood that your claim will win.

Who decides if there is a reasonable chance?

Winn Solicitors will:

  • Review accident details

  • Assess the legal strength of your case

  • Decide whether it meets the 51% success threshold


What happens if my claim is declined?

If your case doesn’t meet the success threshold:

  • You won’t be able to proceed under MLP.

  • You won’t be charged for legal costs incurred before the assessment.

  • You can still seek independent legal advice, but it won’t be covered by Marshmallow.


Can this decision change?

Yes. If new evidence is submitted or circumstances change, Winn Solicitors may reassess your claim.
