The Testator outlines their wishes for:

  • How their assets should be distributed

  • Who should care for minor children (if applicable)

  • Who should serve as Executor to manage the estate

Once the Testator passes away, the Will becomes effective, and the probate court ensures the instructions are followed.

Legal Requirements for a Testator

To create a valid Will, the Testator must generally:

  • Be at least 18 years old

  • Be of sound mind

  • Sign the Will voluntarily and without pressure

  • Sign the Will in the presence of required witnesses (varies by state)
