What are the formalities of a valid common law Will?

There are a couple of things you should be aware of.

Generally, the following are the formalities for a valid Will:

  • It has to be in writing and signed by you and 2 witnesses who all need to be in the presence of each other;

  • you must be 18 or above;

  • you must have the intention to make a Will; and

  • you must have the mental capacity to give instructions to prepare the Will and sign the Will with the witnesses.
