OfferSwap Copyright and EUCD Policy

OfferSwap (“we,” “us,” “our”) respects intellectual property rights and complies with the European Union Copyright Directive (“EUCD”) and other applicable copyright laws. This Copyright Policy (“Policy”) explains how we handle copyright infringement claims and protect the rights of both copyright holders and users on our platform.


1. Scope of the Policy

This Policy applies to all users of the OfferSwap platform (“Platform”), including Service Providers, Service Comparers, and other participants. It governs all content uploaded, shared, or published on the Platform. By using the Platform, you agree to comply with this Policy and adhere to the EUCD and other applicable copyright laws.


2. European Union Copyright Directive (EUCD)

The EUCD provides a framework for protecting intellectual property rights and requires digital platforms to ensure compliance with copyright laws. OfferSwap is committed to adhering to the principles of the EUCD as follows:

  1. Content Identification Tools: We use technology to identify and prevent unauthorized use of copyrighted materials.

  2. Transparent Handling: We ensure fair and prompt handling of copyright notifications and counter-notifications.

  3. User Rights: We provide users with the ability to appeal decisions regarding the removal or restriction of their content.


3. Reporting Copyright Infringement

If you believe that content on the Platform infringes your copyright, you may file an official notification with OfferSwap’s designated copyright agent. Your notification must include the following information:

  1. Identification of the copyrighted work or a representative list if multiple works are affected.

  2. Identification of the material claimed to be infringing and its location on the Platform (e.g., URL or detailed description).

  3. Your contact information, including your full name, mailing address, telephone number, and email address.

  4. A statement that you have a good faith belief that the use of the material is unauthorized by the copyright owner, agent, or the law.

  5. A statement confirming the accuracy of the information in the notification and that you are the copyright owner or authorized to act on the owner’s behalf.

  6. Your physical or electronic signature.

4. OfferSwap’s Response to Notifications

Upon receiving a valid copyright infringement notification, we will:

  1. Promptly investigate the claim to verify its accuracy.

  2. Remove or disable access to the allegedly infringing material.

  3. Notify the user who uploaded the content and provide them with a copy of the infringement notification.

  4. Allow the user to file a counter-notification if they believe the removal was erroneous or legally justified.


5. Submitting a Counter-Notification

If your content has been removed due to an EUCD notification and you believe this was in error, you may submit a counter-notification to the designated copyright agent. Your counter-notification must include:

  1. Identification of the material that was removed or restricted and its location prior to removal.

  2. Your contact information, including your full name, address, telephone number, and email address.

  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or restricted due to a mistake or misidentification.

  4. A statement that you consent to the jurisdiction of the competent court and accept legal service from the party who submitted the original notification.

  5. Your physical or electronic signature.

Users are responsible for ensuring that all content they upload or share complies with copyright laws. This includes:

  • Verifying the origin of the content and ensuring appropriate permissions have been obtained.

  • Avoiding the use of copyrighted material without authorization.


7. Repeat Infringers

OfferSwap enforces a strict policy against repeat infringers. Users who repeatedly upload content that infringes on copyrights may have their accounts terminated and their access to the Platform revoked.


8. Misrepresentations and Liability

Any individual who knowingly submits a false notification may be liable for damages, including legal costs. OfferSwap reserves the right to pursue legal action against those who misuse this Policy.
