This Privacy Policy (the "Policy") describes our policies regarding the collection, use and disclosure of personal information of the Parknsleep platform (the "Platform"), accessible at https://www.parknsleep.app, operated by parknsleep AG ("us", "we", or "our") and its various marketing activities (website parknsleep.eu, offline activities, social media, email messages in HTML format, collectively "Channels").

References and links to third party websites are outside our responsibility. Any responsibility for such websites is disclaimed. Access and use of such websites is at the user's own risk.

What data we collect

Personal data is data that can be used to find out your identity. This includes, for example, your name or e-mail address. However, information that cannot be clearly linked to you, such as the number of visitors to a website, is not considered personal data.

Collection of personal data

When you interact with the Channels, we may collect personal data. These include, but are not limited to:

  • Your name and physical address, as well as your email addresses and phone numbers.

  • Behavioral and demographic attributes, to the extent they are linked to personal identifiers

  • Past transactional behavior on the channels

When you register on and use our Platform, we collect additional personally identifiable information. The data includes, but is not limited to:

  • Your first and last name, personal contact information such as phone number, and email address used for login.

  • When you use the Platform, we collect an audit log of your activity and the date and time of the activity.

  • The payment information we collect from you is forwarded by us to the appropriate payment providers, but is not stored.

  • When using the Platform as a camper, we also collect the license plates of your vehicle and, when booking a pitch, the corresponding location data of the booking

  • When using the platform as a pitch provider, we also collect the address of the pitch and any additional information for advertising and categorizing the pitch.

Collection of usage data

In order to ensure a high level of security and optimal use of our channels and to optimize their availability, we store selected usage data of visitors when they access the channels. There is no evaluation of this usage data to create personal usage profiles.

Usage data includes, but is not limited to:

  • Unique IDs such as a cookie placed on your computer, mobile device or device IDs.

  • Internet Protocol ("IP") address and data derived from your IP address, such as your geographic location

  • Information about your devices such as information contained in HTTP Headers (defined below) or other Internet Transfer Protocol signals, browser or device type and version, operating system, user agent identifiers and information about the presence or use of "apps" on your mobile devices, screen resolution and your preferred language

  • Behavioral data about your use of the Channels, such as web pages clicked, websites and content areas visited, and the date and time of activities

  • The web search you used to locate and navigate to the Channels

Occasionally, we link Usage Data with Personal Data, such as an exact geographic location with your name. If we link usage data to personal data, we treat the linked data as personal data.

How we use and share the data

Personal Data

We use the personal information you share with us for the following purposes:

  • Compliance with legal requirements and company transactions.

    We disclose your personal information as we deem necessary or appropriate for the following reasons: (a) to comply with applicable laws, including laws applicable outside your country of residence; (b) to comply with requirements related to legal process; (c) to comply with requests from governmental and governmental authorities, including governmental and governmental authorities outside your country of residence, for national security and/or law enforcement purposes; (d) to enforce our terms and conditions; and (e) to enable us to pursue available remedies or limit the damages we may suffer.

  • Providing Relevant Product Alerts and Updates

    We will provide you with information related to the Platform. For example, new product releases, alerts, updates, pricing, terms, special offers and related campaigns.

  • Conducting marketing

    We use personal data to inform you about new products and services. Your visit to our channels will be tailored to your interest according to your personal data. In addition, we may measure the success of our marketing campaigns based on personal data.

  • Responding to inquiries

    We use personal data to respond to your inquiries as specifically as possible to add the highest possible value in responding to the inquiry.

  • Interactions on third-party social networks

    We may use personal data to communicate with you on third-party social networks. In doing so, these interactions are subject to the privacy policies and terms of use of the respective network.

  • Improving relevance on channels

    We may use your personal data to personalize content on channels. The focus here is on achieving a higher, personal relevance of the content on the channels.

Usage data

Except as otherwise provided in applicable law, we may use, transfer and disclose other data we collect for any purpose. If we are required by applicable law to treat other data as personal data, we will only use and disclose it in the same manner as personal data.

How we collect data

The Platform's use of automated interactions may change as technology changes. The following describes in more detail how the Platform, currently uses the data collected during automated interactions.

Electronic communication protocols

When you visit web pages or read HTML emails, information is automatically transmitted from you when you connect, due to technology. This is usually information about network access (where you are accessing from), device (hardware and browser or mail client), your IP address (allows conclusions about geographic location and company), and date and time.

Cookies

We use standard market techniques such as cookies or tracking pixels (invisible graphics) on our website. They are used to make our website user-friendly, effective and secure. Cookies are small text files that are stored locally in the cache of the website user's Internet browser and allow the browser in question to be recognized. In addition to so-called session cookies, which are automatically deleted as soon as you log out or close your browser, we also use so-called permanent cookies, for example for the "Stay logged in on this computer" function, which recognize a returning user. Our cookies do not cause any damage to your computer.

You can prevent the installation of cookies by making the appropriate settings in your browser software. Of course, you can delete cookies at any time using the appropriate browser function. If you delete cookies or set your browser to reject cookies, this may affect the function of the website.

Personalized or embedded URLs

We may use personalized or embedded URLs that allow us to identify you even without cookies. When using an obviously personalized or embedded URL, personal data may be collected as you navigate through our website.

Embedded pixels and tracking technologies

We may use embedded pixel technologies in electronic channels that are used to identify individual user visits (as opposed to aggregate visits) or for advertising purposes. Embedded pixels or other technologies may also be used in emails and in online advertising. In this case, they provide information about when an email or ad was opened and how effective marketing campaigns are. Data collected using these technologies may be linked to the recipient's email address.

Payment procedures

In the context of contractual and other legal relationships, due to legal obligations or otherwise based on our legitimate interests, we use functions of the payment service provider Stripe. The provider is Stripe Inc, 510 Townsend Street, San Francisco, CA 94103, USA.

The data processed by the payment service providers includes personal data, such as the name and address, bank data, such as account numbers or credit card numbers, as well as contract, sum and recipient-related information. The verification on the part of Stripe-Connect is established with an upload of the identity card (ID). The information is required in order to carry out the transactions. However, the data entered is only processed by the payment service providers and stored with them. I.e., we do not receive any account or credit card related information, but only information with confirmation or negative information of the payment. Under certain circumstances, the payment service providers transmit the data to credit agencies. The purpose of this transmission is to check identity and creditworthiness. In this regard, we refer to the terms and conditions and data protection information of the payment service providers.

For payment transactions, the terms and conditions and data protection notices of the respective payment service providers apply, which can be accessed within the respective websites or transaction applications. We also refer to these for the purpose of further information and assertion of revocation, information and other data subject rights.

Third-party analytics and tools Cookies

What types of cookies do we use:

  • SessionCookie: to identify the current visitor.

  • ConfigCookies: to store certain states / preferences on the website.

  • Google Analytics cookies: the usual tracking cookies from GA.

Google Tag Manager

We use the Google Tag Manager on our website. Through this service, website tags can be managed via an interface. The Google Tag Manager only implements tags. No cookies are set and no personal data is collected. The Google Tag Manager triggers other tags that may collect data. The Google Tag Manager does not access this data. If a deactivation has been made at the domain or cookie level, it remains in place for all tracking tags, insofar as these are implemented with the Google Tag Manager. The user has the option to prevent all tags of the Google Tag Manager from being sent. To do this, the user must click on the opt-out link below to place the Google Tag Manager deactivation cookie in their browser.

Google Analytics

Our platform uses functions of the web analysis service Google Analytics. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

IP anonymization is used on our platform. The IP address of users is truncated within the member states of the EU and the European Economic Area and in the other states party to the agreement. Google Analytics also uses cookies. These are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. The storage of Google Analytics cookies is based on Art. 6 para. 1 lit. f. DSGVO.

Posthog

We use functions of the service Posthog in our platform. These functions are offered by Posthog Inc, 965 Mission Street, San Francisco, CA 94103 USA integrated. Posthog can record and reflect your behavior on our website. The storage of this data is limited in time and is used exclusively to improve our service based on your needs.

Facebook

We use functions of Facebook, a social media network of the company Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland, in our platform. You can find out which functions (social plug-ins) Facebook provides at https://developers.facebook.com/docs/plugins/.

By visiting our website, information may be transmitted to Facebook. If you have a Facebook account, Facebook can assign this data to your personal account. If you do not wish this to happen, please log out of Facebook.

Twitter

We use functions of Twitter, a social media network of Twitter International Company, One Cumberland Place, Fenian Street, Dublin 2 D02 AX07, Ireland, in our platform. This may also transfer personal data to Twitter. We do not monitor this data exchange and do not store anything about it.

Instagram

We use functions of the service Instagram in our platform. These functions are offered by Instagram Inc., 1601 Willow Road, Menlo Park, CA, 94025 USA. If you are logged into your Instagram account, you can link the content of our site to your Instagram profile by clicking on the Instagram button. This allows Instagram to associate the visit to our pages with your user account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Instagram. Mailchimp

We use functions of the Mailchimp service in our platform. These functions are offered by The Rocket Science Group LLC d/b/a Mailchimp, Attn. Privacy Officer, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.

The newsletters and media releases of the platform are sent using the newsletter program Mailchimp. The registration of an e-mail address for the newsletter and media release dispatch is done via the opt-in procedure. Each mail sent contains a link with which the addressee can unsubscribe from the newsletter list.

The e-mail addresses of the subscribers to our newsletters and, if applicable, their first and last names are stored on Mailchimp's servers in the USA. Mailchimp uses this information on our behalf to send and evaluate the newsletters. Mailchimp can use this data to optimize its own services. However, Mailchimp does not write to the recipients independently. Your data may also be passed on to third parties to fulfill the listed purposes. Likewise, Mailchimp reserves the right to share your data for advertising purposes in collaborations with advertising networks and social media.

The emails are sent via various servers in Europe (and exceptionally in the USA). The following data, among others, is collected from these e-mails, stored in the USA and made available to Consumer Protection as reports: Bounce rates, open rates and click rates.

Information and data correction / deletion of data

Upon request, we will inform you at any time about the data we have stored about you. If, despite our efforts to ensure that your data is correct, complete and up to date, we have stored incorrect information, we will correct it immediately at your request.

Retention and deletion

The criterion for the duration of storage of personal data is the respective statutory retention period. After expiry of the period, the corresponding data is routinely deleted, provided that it is no longer required for the fulfillment or initiation of the contract.

Security through technical and organizational measures

In accordance with Article 32 (1) EU-DSGVO, we use technical and organizational measures for security in the processing of data in order to protect personal data against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. The security measures in use are regularly reviewed and improved in line with technological developments.

Protection of minors

Persons who have not yet reached the age of 16 may not transmit personal information to us without the consent of their legal guardians. Personal information may only be provided to us by persons who have not yet reached the age of 16 if the express consent of their legal guardians has been obtained or if the persons have reached the age of 16 or are older. This data will be processed in accordance with these guidelines.

International transfer

If we process data in a third country (i.e. outside the European Union (EU) or one with adequacy status as a safe third country on the part of the EU) or if this is done in the context of using third-party services or disclosing, or transferring data to third parties, this will only be done if it is done in order to fulfill our (pre)contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, we process or allow the processing of data in a third country only if the special requirements of Art. 44 et seq. DSGVO are met. This means that the processing is carried out, for example, on the basis of special guarantees, such as the officially recognized determination of a level of data protection that corresponds to the EU (e.g. for the USA through the "Privacy Shield") or compliance with officially recognized special contractual obligations (so-called "standard contractual clauses").

Confidential Data

We ask that you do not send or share any sensitive personal information (e.g., social security numbers, racial or ethnic information, political opinions, religious or other beliefs, health, criminal history, or union membership) with us.
