As part of Road Ninja’s commitment to providing trusted contractors, we perform complimentary background checks, including the Ministry of Justice’s 'All Convictions Report', on all contractors booked through our platform.
These checks are exclusive to contractors booked via Road Ninja. For drivers applying directly to your company through our job board product, you are responsible for conducting your own background checks based on your hiring policies.
For specific legal information on our background checks, head over to our Terms of Use for Customers and Drivers.
What is the 'All Convictions Report'?
The 'All Convictions Report' is a background check provided by the Ministry of Justice that reveals whether a contractor has a criminal record (also known as a criminal conviction history).
For context, a criminal record covers:
Criminal convictions
Traffic convictions
It does not include:
Infringements, such as parking tickets
Charges that haven’t gone to court yet
Any charges where you weren’t convicted
Times you’ve gone to court and were found not guilty
Military (Court Martial) convictions
Overseas convictions
Police diversions
Charges in the Youth Court
Demerit points and driver licence suspensions.
Compliance with the Criminal Records (Clean Slate) Act 2004
The results of a driver's 'All Convictions Report' meeting the criteria set out in the 'Clean Slate Scheme' (see below) dictates whether that driver is visible on the Road Ninja platform and available for hire by hiring companies.
You’re said to have no criminal record (criminal conviction history) if all of the following are true. If you have:
Had no convictions within the last 7 years
Never been sentenced to a custodial sentence (such as prison, corrective training or borstal)
Never been convicted of a ‘specified offence’ as listed in section 4 of the Criminal Records (Clean Slate) Act 2004(external link).
Fully paid any fine, compensation, reparation or costs ordered by the court in a criminal case
Never been banned from driving until further notice (indefinite disqualification)
Never been held in hospital by the court in a criminal case instead of being sentenced, due to your mental condition.
What this ultimately means
If a driver doesn't meet the criteria of the Clean Slate Scheme, we take all reasonable precautions to ensure that they're not available on Road Ninja for hire.
This current stance is less about our position on New Zealanders with a criminal conviction and more about our current Road Ninja functionality suite; we're currently looking at ways to sensitively communicate any past convictions to hiring companies on the Road Ninja platform (with full transparency and permission from drivers), as we believe that the choice to hire a driver with a criminal record should ultimately be at the discretion of the hiring company.
