Review Office action text in the display and edit field provided for correctly identified Examiner issue statements (highlighted gray).
Note that the left-hand panel provides navigation links to issue statements identified in the text display and edit field.
If identified issue statements contain typos or OCR errors, correct the highlighted text directly in the display and edit field.
Note that these errors may impact detected prior art, and may be carried into your response if not corrected. However, errors that are not part of issue statements may be left uncorrected without affecting your response.
Modify, add, and remove issue statements as needed, according to guidance provided below.
Review detected art and modify, add, and remove art as needed.
Note that the left-hand panel art listings include on-hover controls to highlight detected art reference in the text display and edit field.
Once you're satisfied with the detected data, click Generate Package to complete package generation.
Rowan Patents does its best to correctly analyze and identify the issue statements and cited art that are used to build your response package. However, unconventional Examiner phrasing, typos, and OCR issues can cause analysis errors. The controls described below and our troubleshooting tips are provided to keep you moving forward with your work when errors occur.
Modify Issue Statement Text and/or Type
Click the highlighted issue statement in question.
Select Modify.
Click and drag your mouse to highlight the text you want identified as the issue statement and used in the response.
If needed, select the desired issue type in the dialog provided to the upper right.
Click Apply.
Note that your selected text is now highlighted as the issue statement and the left-hand panel listing shows the selected issue type, as applicable.
Add an Issue Statement
Click Add Issue in the upper right corner of the text display and edit field.
Click and drag your mouse to highlight all of the text you want identified as the issue statement and used in the response.
Select the desired issue type in the dialog provided to the upper right.
Click Add.
Note that your selected text is now highlighted as the issue statement and the left-hand panel listing shows the selected issue type.
Remove an Issue Statement
Click the issue statement in question.
Select Remove.
Note that the text is not deleted from the OA display and edit field, only the metadata (and thus the highlighting and left-hand listing) identifying that text as an issue statement.
Modify Listed Art
Hover over the art where it is listed in the left-hand panel.
Click the pencil icon provided on hover.
Make any corrections needed in the art reference number.
Click OK.
Note that information for the art will be updated in the left-hand listing. If the detected art is included in an issue statement, it will be listed as Cited Art. Ensuring the correct art is listed for 102 and 103 rejections is key to including the correct clean and annotated cited art in the response package.
Add Art to the Listing
Click the plus sign icon provided to the right of the Cited Art heading in the left-hand panel.
Enter the reference number for the desired USPTO application or publication.
Note that art filed in other jurisdictions and non-patent literature cannot be added at this time.
Click Add.
Note that the author will be automatically detected and the art added to the left-hand listing. If the art does not appear in an issue statement, it will be added as Other Art rather than Cited Art.
