When to expect your tax documents from Slay Markets and how to read them.

Slay Markets provides a 1099-B to clients who had reportable futures trading activity during the tax year, and it is the primary document you need to file your U.S. federal income tax return for that trading. Your Slay Markets 1099-B is available to download from your Account Dashboard by February 15 of the year following the tax year, which is the IRS broker delivery deadline. For futures (Section 1256 contracts), the key number is Box 11, your aggregate gain or loss, which you transfer to IRS Form 6781. If you had prior-year trading activity and have not received your 1099-B by February 20, contact support@slaymarkets.com.

This article provides general educational information about 1099-B reporting. Slay Markets provides official tax documents but does not provide tax advice. Consult a qualified tax professional or CPA for advice on your personal tax obligations.

Who receives a 1099-B from Slay Markets

Slay Markets issues a 1099-B for futures trading to clients who meet either of the conditions below. You will receive a 1099-B if you:

  • Are a U.S. person (citizen, permanent resident, or resident for tax purposes) and had any futures trading activity — open and close transactions — during the calendar year.

  • Had any open Section 1256 positions at December 31 that were subject to mark-to-market treatment.

You may not receive a Slay Markets 1099-B if you had no trading activity, only open positions with no closes, or if you are a non-U.S. person (different reporting may apply — consult your tax advisor).

How to read the boxes on your Slay Markets 1099-B

Because Slay Markets futures are Section 1256 contracts, your 1099-B reports four boxes specific to Section 1256 trading. Box 8 (Profit or loss from Section 1256 contracts) shows your net realized gain or loss from all closed futures positions during the year. Box 9 (Unrealized profit or loss on open contracts at 12/31) shows the mark-to-market gain or loss on positions open at December 31 of the prior year. Box 10 (Unrealized profit or loss on open contracts at 12/31 of the current year) shows the mark-to-market gain or loss on positions open at December 31 of the current tax year. Box 11 (Aggregate profit or loss from Section 1256 contracts) is the net of Boxes 8, 9, and 10, and is the figure you transfer to IRS Form 6781. The same four boxes are summarized in the table below.

Box / Field

What It Shows

Box 8 — Profit or (loss) from Section 1256 contracts

Your net realized gain or loss from all closed futures positions during the year.

Box 9 — Unrealized profit (loss) on open contracts — 12/31

The mark-to-market gain or loss on positions open at December 31 of the prior year.

Box 10 — Unrealized profit (loss) on open contracts — 12/31 current year

The mark-to-market gain or loss on positions open at December 31 of the current tax year.

Box 11 — Aggregate profit or (loss) from Section 1256 contracts

The net of Boxes 8, 9, and 10. This is the figure you transfer to Form 6781.

The number in Box 11 of your Slay Markets 1099-B is your total Section 1256 gain or loss for the year after mark-to-market adjustments. To use this number on your return, report the Box 11 figure on IRS Form 6781 (Gains and Losses From Section 1256 Contracts and Straddles); Form 6781 applies the 60/40 split — 60% of the net is treated as long-term and 40% as short-term, regardless of how long you held the position — and that result then flows to Schedule D. Q: Where does Box 11 of my Slay Markets 1099-B go on my tax return?

A: Box 11 of your Slay Markets 1099-B is your aggregate Section 1256 gain or loss for the year after mark-to-market adjustments. Transfer the Box 11 figure to IRS Form 6781, which applies the 60/40 long-term and short-term split; the result then flows to Schedule D. See Tax Treatment of Futures for more detail.
