At Spenny Piggy, our goal is to nurture a vibrant and supportive community for our creators while upholding the intellectual property rights of others. Here are our guidelines to ensure a balanced and fair use of copyrighted materials on our platform.
Spenny Piggy is dedicated to maintaining a responsible platform, but we don't serve as the ultimate authority in resolving copyright disputes. Should you encounter a copyright issue, you might need to engage directly with the other party, seek legal advice, and follow legal procedures if necessary. While we manage DMCA notices and counter-notices, our involvement is limited.
By using Spenny Piggy, you agree that handling copyright disputes is primarily the responsibility of the parties involved. Spenny Piggy does not offer legal advice nor confirm copyright claims. Itโs up to you to comply with copyright laws and seek legal help when required.
Creator's Rights and Duties
As a creator, ensure that the content you share on Spenny Piggy is either your own original work or that you have the proper permissions to use any copyrighted material.
If your content includes copyrighted material, you must give proper credit to the original creator or copyright holder. This involves citing sources, linking to the original work, and displaying the appropriate credits.
Ensure that any content you create or share, such as comments, forum posts, or interactions, does not infringe on others' intellectual property rights. While Spenny Piggy can monitor, review, or remove content, it is ultimately your responsibility to respect these rights.
You may use copyrighted material under the fair use doctrine for purposes such as criticism, commentary, news reporting, teaching, scholarship, or research. Examples include quoting a book passage in a review or using a short clip from a movie for educational purposes. Fair use is complex and determined on a case-by-case basis, so consult legal counsel if youโre unsure.
Spenny Piggy permits creators to use works in the public domain, which are not protected by copyright and can be freely used. However, rules can differ by country, so make sure you understand the specific laws that apply to your jurisdiction.
Reporting Copyright Violations
If you believe your copyrighted work has been used without your permission, you can report it by clicking the ellipsis (...) at the top right of a user's Spenny Piggy profile, selecting 'Report Abuse', and choosing 'Copyright issue' as the reason. Fill out the rest of the form to complete the report.
We take copyright infringement reports seriously and review them based on the information provided. If we cannot validate a notice or counter-notice, we may require the parties to resolve the matter through legal action.
Submitting forged DMCA notices is a grave matter. If we determine that a DMCA notice is forged, we will take appropriate actions, including potentially reporting the incident to the relevant authorities.
Responding to Copyright Claims
If we can definitively confirm the validity of a DMCA notice, we will remove or disable access to the infringing content and notify the creator.
If you believe your content was wrongly removed or disabled, you can submit a counter-notice, including:
- Your signature (physical or electronic)
- Identification of the removed material and its prior location
- A statement under penalty of perjury that you believe the removal was a mistake
- Your contact details and consent to the jurisdiction of the appropriate court
We may reinstate your content unless the copyright holder initiates legal action.
Repeat Offenders
Spenny Piggy reserves the right to permanently unpublish users who repeatedly violate copyright laws. We will determine "repeat infringer" based on factors such as the number of infringement claims and the nature of the content.
Updates to These Guidelines
We may update these guidelines as we continue to improve our platform and services. Please review these guidelines regularly, as continuing to use the platform signifies your acceptance of any changes.
Consequences of Non-Compliance
By using Spenny Piggy, you agree to adhere to our guidelines and ensure your content complies with copyright laws. If we receive a valid infringement claim against your content or discover violations, we may remove or disable access to the offending content. Repeated or severe violations could result in the permanent unpublishing of your page/account.
