Align Tech was awarded $63m, which SDC would have to pay, in an arbitration case in May 2023. On 21 August 2023, the Superior Court (California) confirmed this award. The latter would become payable on 29 September 2023.

SDC files for chapter 11 in the US. Business remains operational in the US and UK. Customers continue buying and SDC continues servicing existing cases. No material impact on operations in the UK.

Founders provided $30m DIP financing to support the global operations during the chapter 11 process.

SDC US entity delisted from Nasdaq on 4 October 2023.

During administration, the business remained operational in the US and abroad. SDC continued servicing existing cases and customers could start new ones.

SDC failed to agree terms for restructuring and has to be liquidated. The website was updated or rather shut down. US and UK customers have no access to support by email or phone.

15 December 2023

It is yet to be determined what happens to the UK business. No UK insolvency proceedings have been initiated. We expect SDC to make a decision soon.
