Can I Participate in My Company’s ICHRA if I’m on My Spouse’s Employer Group Plan?

No. If you are enrolled in your spouse’s employer‑sponsored group health plan, you cannot participate in your employer’s ICHRA unless you opt out of that group plan and enroll in individual health insurance.

If You Are Currently Enrolled in Your Spouse’s Employer Group Plan
