If an employee has a spouse that is covered by Medicaid, can that spouse get reimbursed with an ICHRA?
No. An employee's spouse who is enrolled in Medicaid cannot get reimbursed through an ICHRA. Just like employees, dependents (such as a spouse) must be enrolled in a qualified individual health insurance plan in order to have premiums reimbursed through an ICHRA. Since Medicaid is a government program, it is not considered eligible for reimbursement under ICHRA rules.
Only premiums for individual health insurance plans purchased privately or through a marketplace, which meet specific criteria, are eligible for ICHRA reimbursement.
