Guide: Checking Eligibility for the Childrenās Barred List
This guide will help you decide if a job requires an Enhanced DBS check with a Childrenās Barred List check for working with children. Follow these steps to see if the role qualifies.
Step 1: Is the Role Regulated Activity with Children?
Regulated activity involves work that a person on the Childrenās Barred List cannot do. Check if the job involves any of these:
Activities with Children:
Teaching, training, instructing, caring for, or supervising children: Must happen more than 3 days in a 30-day period, or overnight (2am - 6am) with face-to-face contact.
Providing advice or guidance: If it's mainly for children's education, emotional, or physical well-being, and happens more than 3 days in a 30-day period, or overnight.
Moderating a web service for children: If this is done more than 3 days in a 30-day period.
Driving a vehicle solely for children: If this is done more than 3 days in a 30-day period.
Healthcare or personal care: Just once is enough for it to be considered regulated.
Registering as a foster carer or childminder: Automatically qualifies.
ā
Specified Establishments:
Is the job at a place like a school, nursery, childrenās home, or detention center for children?
If yes, and the person works there more than 3 days in 30 days, or overnight, and has the chance to interact with children, it qualifies.
ā
Step 2: Consider the Roleās Frequency
Frequency: Does the role meet the activity or establishment frequency conditions? (More than 3 days in 30 days, or overnight)
Step 3: Does the Role Involve Supervising Others in Regulated Activity?
Management and supervision: If someone is responsible for managing or supervising someone else in regulated activity, their role also counts as regulated activity.
Step 4: Changes to the Role
If the role or the activities involved change, this could affect the eligibility for a DBS check with a Childrenās Barred List check. Always re-evaluate using the government guidance and criteria.
Step 5: Refer to Additional Resources
If unsure, use the online eligibility tool (linked at the bottom of this page) or consult DBS guidance.
You have a legal duty to refer someone to DBS if certain conditions are met. For more information on making referrals, access the DBS barring referrals leaflet or call 03000 200 190.
