Does BarMax use real questions?

Yes — and this is one of the most important things to understand when comparing bar prep providers. BarMax licenses every real, officially-released NCBE multiple choice question, paired with detailed explanations. We do not write our own MBE questions, and we do not include simulated or "inspired-by" questions in our bank.

This sounds like a small distinction. It isn't. Here's why it matters more than almost any other factor when you're choosing a bar prep course.

What "real questions" actually means

The National Conference of Bar Examiners (NCBE) writes and administers the MBE, the multiple-choice portion of every UBE and many state bar exams. After each administration, the NCBE releases a subset of those exam questions for use in study materials. Those officially-released questions — and only those — are the real MBE questions. Everything else in any prep company's question bank is something a non-NCBE writer composed in the style of an MBE question.

The difference between practicing on real NCBE questions and practicing on simulated questions is roughly the difference between scrimmaging against a professional team and scrimmaging against college players. Both look similar from a distance. The reasoning patterns, the subtle traps in answer choices, the way facts are emphasized or buried — those are learned skills, and they're best learned on the genuine article.

Why most prep companies pad their question counts

If you've shopped around, you've probably noticed that some competitors advertise question banks with much larger totals than BarMax — sometimes 4,000 or 5,000+ questions. Here's what's almost always going on: the majority of those questions were written by the prep company's in-house staff or contract writers, not the NCBE. They're modeled on real MBE questions, but they're not the real thing.

There are two reasons this matters:

  1. The reasoning patterns don't quite match. NCBE questions test legal reasoning in characteristic ways that come from decades of psychometric refinement. Simulated questions, no matter how well-written, drift from those patterns in subtle ways — and the more time you spend training on the drift, the less calibrated you'll be on exam day.

  2. The explanations are weaker. When the prep company writes the question, they're also writing the explanation — which means there's no independent test of whether their analysis matches the NCBE's reasoning. With real NCBE questions, our explanations work backward from the actual correct answer the NCBE chose, ensuring our analysis aligns with the exam's own logic.
