Executive Home Occupancy Agreement

THIS AGREEMENT is made this 8th day of March, 2023 between

  1. Premises

The Owner will provide the Occupants the ability to occupy a one-bedroom apartment located at:

  1. Securing the unit for Occupancy

Once the total amount of money has been received the owner will ensure the property is reserved for the occupant. Until payment of the term and deposit fee has been received in full, the owner reserves the right to negotiate with other parties.

  1. Occupancy Begins

Occupancy will begin on March 12, 2023 and will continue until May 21, 2023 until terminated on a month-to-month basis (the "Term") at the rate of $2,600.00 per month ("Monthly Rent"). Monthly rent will be due and payable on the first day of each month, subject to prorations for any days less than a full month. Lessee anticipates at this time that the vacate date will be May 21, 2023 (the “Anticipated Vacate Date”). Should the Anticipated Vacate Date change, Lessee will provide you with 30 calendar days advance written notice of intent to vacate. Lessee will not be liable for any rent beyond expiration of the 30-calendar day period. No security deposit required by Landlord. Utilities and internet will be paid directly by the Landlord to the applicable utility companies.

A check for the first month of prorated rent (3/12-3/31) and 1 x $80 cleaning fee will be sent upon execution of this letter lease agreement.

The Resident residing in the Premises is a guest of Lessee and shall not be liable for rent.Landlord will be responsible for maintaining the Premises in a state of good repair and warrant that the Premises are suitable for habitation. Lessee agrees to be responsible for any damages caused by Resident, reasonable wear and tear excepted.

The Occupants agree to pay the Owner by;

Occupant will pay based on the below payment schedule.

  • $1,757.42 on March 12th, 2023

  • $2,600.00 on April 1st, 2023

  • $1,761.29 on May 1st. 2023

If the occupant wants to terminate the contract prior to May 21, 2023, the occupant must provide Owner with a 30-day notice period and pay the rent owed for the 30-day period.

5. Occupants

  1. Weatherby Healthcare (1 total people); will remain at the property for the full 70-night agreement only

6. Arrival and Departure

Occupants will arrive after 4:00pm on the date the agreement begins. Occupants will depart no later than 11:00am on the day the agreement ends. Arrival and departure times may be altered if agreed to by the Owner in advance.

7. Cleaning Service

The Occupants will pay to the Owner a total of $80 for the cleaning fee and will be made payable to the Owner prior to check-in and it will be applied to cleaning upon checkout.

This cleaning service will be responsible for a routine cleaning, including vacuuming, washing and sanitizing the property, and ensure the home is maintained in a clean order for the next guests.

The Occupants agree to keep the home in a clean, well-kept state during their stay. This includes, but is not limited to, returning all indoor and outdoor furniture back to its original place, dishes and cutlery must be washed and returned back to their respective places, remove all recycling and garbage from the home and put

outside for city garbage removal, beds must be stripped of the linen and any washed linens must be folded and placed on the beds.

Failure to meet the above requirements will result in a holdback of some or all of the Occupant’s deposit in order to pay for the extra cleaning.

Garbage and recycling

The Occupants are required to place all recycling and garbage as instructed by the apartment building. Each floor has a garbage chute where garbage should be properly disposed of. Improper disposal of garbage will lead to fines as outlined by the apartment building.

Guests

Only the Occupants will be permitted to reside and use the property. No parties will be held at the property and only guests approved by the Owner are permitted on the property. The Occupants are not permitted to in any way assign or sub occupy the property without prior written approval of the Owner.

Smoking

The Occupants agree that smoking and vaping are not permitted in the property under any circumstances. Occupants and their approved guests may smoke at a

minimum 3 meters away from the property. Cigarette butts must be completely extinguished and disposed of in a secured ashtray and not on the grounds.

Pets

The Occupants agree no pets are allowed on the property.

Telephone and Internet usage

The Occupants will not have access to a telephone service, but unlimited internet usage is available during their stay. The television is a smartTV for the Occupants to use.

Cancellation and amendment policy

If the Occupants wish to cancel the agreement or move out earlier, Occupant agrees to provide a 30-day notice period and pay the agreed rental amount for that 30-day period. The agreed amount is $2,600.00 for the 30-day period.

Rental Agreement

The Owner and the Occupants agree that this Agreement is not governed by the Minnesota Landlord Tenant Laws are set forth in the Minnesota Statutes, Chapter 504B rather it is governed by the terms set forth in this Agreement. This occupancy agreement is exempt from the RTA.

General Terms

The Occupants agree to be respectful to all surrounding neighbours to the premises, and will respect property lines, refrain from profanity and playing loud music after 10pm for the children and the elderly who live in the neighbourhood.

Bed linen and towels will be provided to the Occupants, and will be the Occupant’s responsibility to clean and maintain these items during their short-term stay.

Items such as toilet paper, soap, paper towels, salt and pepper and other items will be provided initially when the Occupants move in, but will not be replaced and

replenished through the term of the agreement. Occupants will be responsible for replacing and replenishing these items as needed.

Occupants must keep all surfaces clean and in an organized fashion, including the kitchen and bathrooms.

All food must be emptied from the fridge by the Occupants before the term of the agreement is up.

Occupants shall not make any alterations or improvements to the property or premises without the Owner's prior written consent

HOUSE RULES SUMMARY

《 NO SMOKING 》

Smoking indoors will result in a $500.00 fine. Removing smoke smell and nicotine from the walls is an extremely time intensive process.

《 PETS 》

Pets must be registered prior to check-in. Evidence of pets unregistered pets will result in a $200.00 fine charged to guests.

➤Certain breed restrictions apply including, but not limited to, mastiff, Pitbull, Rottweiler, and Doberman pinscher

《 PET ETIQUETTE》

Pet rules must be respected. Pets shall only potty outdoors and/or in the designated areas in the community. Guests found disrespecting the community policies may be fined and/or may have their reservation cancelled without refund.

《 NO PARTIES》

There is a $250.00 surcharge charged to groups that are deceitful about the use of the unit. Please be transparent and honest. Guests partying will be asked to vacate the property immediately without refund.

《 NO UNREGISTERED GUESTS》

All guests must be registered for liability purposes.

➤A surcharge of $100.00 per undeclared guest per night will be applied for each unapproved guest. Our cleaners and inventory is scheduled and prepared according to the number of guests occupying the unit.**

《 SECURITY CAMERA 》

Under no circumstances is the security camera to be removed or disabled in any way that is found on the outer door frame of the unit. This is a stipulation and requirement from building management for our units and the camera must be functional at all times. Any cameras removed or disabled will be considered a violation of the booking and a fine of $500 is applicable. This security camera captures activity Outside of the unit only.

《 CHECK-OUT TIMES 》

Check-out times are firm unless scheduled and confirmed 24 hours in advance and only if it does not disturb upcoming guest reservations.

➤$50.00/hour penalty is applied if guests fail to check out by 11am as my cleaners are on tight schedules.

《 GARBAGE 》

Garbage is to be thrown out in a sealed bag in the trash chute on your floor. Garbage is not to accumulate in the unit and is not to be disposed of anywhere else in the building and community amenities.

《 LOCK ALL WINDOWS & DOORS 》

Please lock all windows and doors if you are not home and upon check-out.

《 LIGHTS 》

Please turn off lights when not in use. Please make sure all lights are turned OFF at the time of check-out.

《 SHOES》

Outdoor shoes are to be left by the front door and not to be worn throughout the inside of the unit.

《 MAIL》

You may use the virtual key/code that we sent you to access the mailroom. This code is the same code that you used when you enter the building.

《 COMMUNITY POLICIES & RULES 》

We appreciate guests who value maintaining the integrity of the building community and its rules and policies. By confirming this reservation, you comply to respect any written apartment rules and community policies, including instructions for care of our property. Any substantiated complaints from the building may result in fines and/or cancellation of your reservation without refund.

《 CHECK-OUT PROCEDURES 》

➤Please wash, clean and put all dishes away. Cleaning dishes is not included in the cleaning fee.

➤Please place all used towels and linens on the bathroom floor.

➤Please throw all waste away prior to check-out.

➤We appreciate guests who respect the home and encourage guests to leave the home in good condition to keep our cleaning fees reasonable so we can continue to offer guests an amazing experience.

《 KEYS & FOBS 》

Lost keys and fobs are subject to a replacement fee of $100 for keys and $150 for fobs. Please return keys and fobs to the lock box at the time of check-out. Key and fobs that are not returned into the lock box on the door frame of the unit will be deemed lost and may be subject to replacement fees. Please ensure the lock box has been closed securely.

✦《 RESERVATION EXTENSION POLICY 》✦

Guests looking to extend their stay are welcome to do so, subject to availability. Please note, we require a 48 hour notice MINIMUM prior to checkout time to extend without penalty.

All extension requests that are between 24-48 hours before checkout time are subject to an additional 50% of the cleaning fee to reschedule cleaners.

Any extension request that is less than 24 hours before checkout time will be subject to an additional cleaning fee.

Please note that all additional fees must be paid first before an extension is confirmed. Our cleaners operate on strict schedules and 100% of the fees go to our hard working cleaners to compensate them for the last minute changes.

I understand that any damage, loss or unkemptness to the property will be remedied at my own expense.

WAIVER AND RELEASE OF LIABILITY

& ASSUMPTION OF RISK ACKNOWLEDGEMENT

(To be signed by all parties 18 and older as of the day of checking in)

Occupancy Dates: 4pm the 12th day of March, 2023, and ending at 11am May 21st, 2023

DEFINITIONS: Facilities/Premises:

Indemnitee – Baetelle LP

Indemnitor – The individual(s)/ Company representatives signing below hereinafter also referred to as the Occupant(s) and his/her heirs, administrators, and executors.

The Indemnitor hereby releases the Indemnitee from any liability for damages from illness, injury and/or death that arises out of, or is connected with, or in any manner relates to, Indemnitor’s use of the Facilities and services provided at the Facilities, and will save them harmless in respect thereof.

Indemnitor represents that:

1. I am 18 years of age or older.

2. I am submitting this release, waiver of liability, and assumption of risk declaration voluntarily and of my own free will, on behalf of myself and my family (which may include children under the age of 18 years) and any of our guests who may visit the facilities in order to save harmless the Indemnitee from any possible claims therefrom.

3. I have no physical or psychological conditions, nor any history thereof, which will impair my ability to utilize the Facilities and its services in a safe manner.

4. I understand and agree that it is my responsibility to assess the hazards presented by my use of the Facilities and services of the Facilities, and further agree that I assume all risks associated with the exercise of personal judgment about the use of said Facilities and services.

5. I understand and EXPRESSLY ASSUME all the dangers incident to using the Facilities and their services, and hereby RELEASE ALL CLAIMS, including but not limited to, personal injury, property damage or destruction, and death, whether caused by NEGLIGENCE, breach of contract or otherwise, and whether for bodily injury, property damage or loss otherwise, which I may ever have against the Indemnitee.

6. My use of the Facilities listed above is entirely optional and my own free choice.

7. All personal property of the Indemnitee placed in the rented premises, or in any other portion of the property on which the premises is located, shall be at the sole risk of the Indemnitor and the Owner shall in no event be liable for loss, deduction, theft, or damage to such property unless caused by or resulting from negligence of the Owner, or his employees.

8. I hereby undertake and agree to be fully responsible for the cost of repair for any damages caused to any of the property, equipment or belongings of the Indemnitee beyond reasonable wear and tear incident upon normal use.

9. I hereby agree to indemnify and save harmless Baetelle LP, the owners, from any and all claims whatsoever in accordance with the foregoing.

10. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the parties irrevocably agree that any dispute arising out of or in connection with this Agreement will be subject to and within the jurisdiction of the laws of Ontario and Canada applicable therein. Both parties agree that any action or proceeding relating to this Agreement will be brought to a court of competent jurisdiction in the Province of Ontario, Canada.
