Does Wealth.com draft irrevocable trusts?

The platform allows for the creation of Revocable Trusts (Joint or Individual). This includes the following ancillary documents: pour-over will, schedule of property, tangible personal property list (if applicable for the jurisdiction), and a certification of trust. However, we do not currently support the creation of a stand-alone irrevocable trust document on the platform.

Importantly, the Revocable Trust and Will workflows also allows for the creation of several robust subtrusts (or testamentary trusts) - which are irrevocable trusts that are created at the death of the grantor(s). These include the following:

  • Family Trust (also known as a Credit Shelter Trust, Bypass Trust or Disclaimer Trust)

    • The Family Trust created on our platform are funded by a disclaimer by the surviving spouse.

  • Marital Trust

  • Trust for Descendants (children or grandchildren, for example)

Our revocable trust agreements also contain provisions that dictate how retirement account funds (like IRAs and 401(k)s) would be handled after the account owner’s death if a subtrust is named as a beneficiary of a retirement account.
