What should I look for in naming a health care agent?

Ideally, your health care agent would have a strong sense of responsibility, be a good communicator and responsive, and know your wishes regarding your health and your body. This person should be able to communicate effectively with your medical team and your loved ones.

You do not have to choose the same person who would be in charge of your finances (such as your executor or agent in a financial power of attorney).

What to look for:

  • At least 18 years old

  • Strong sense of responsibility (for example, this person is willing to follow the instructions in your directive, even if the person does not personally agree with them)

  • Diligence and responsiveness

  • Has some familiarity with the medical system

  • Lives close to you or is willing to travel to your home regularly

Concerns to consider:

  • Unresponsiveness in daily communications with you currently

  • Is intimidated by medical terms or important decisions such as withdrawal of support

  • Moral or religious beliefs that are significantly different than your own

  • Lives abroad or in a much different time zone from you
