TERMS AND CONDITIONS

  1. INTRODUCTION

1.1. These terms and conditions (the “Terms”) govern the Zable Car Loan Switching Voucher Programme (the “Programme”) operated by Lendable Ltd (“Lendable” or “we” or “us”).

1.2. The Programme offers eligible customers (the “Eligible Customer(s)”) the opportunity to receive a voucher incentive (the “Voucher”) when they successfully apply for and draw down an AutoLend refinance loan (the “AutoLend Product”) provided they meet the conditions set out in these Terms.

1.3. By participating in the Programme, you agree to be bound by these Terms.

2. ELIGIBILITY

2.1 To be eligible to participate in the Programme and receive a Voucher, you must meet the following eligibility criteria:

(a) be at least 18 years of age;

(b) be a resident of the United Kingdom; and

(c) apply for an Autolend Product yourself under the Programme.

2.2 Lendable reserves the right to determine, in its sole discretion, whether a customer meets the eligibility criteria.

3. CONDITIONS FOR RECEIVING THE VOUCHER

3.1 A Voucher will only be issued if all of the following conditions are satisfied:

(a) you submitted a complete application for an AutoLend Product and were approved by Lendable;

(b) the loan funds were disbursed to your existing lender as part of the refinance loan disbursal;

(c) you did not exercise your right to withdraw from the AutoLend credit agreement during the applicable statutory withdrawal period (the “Withdrawal Period”); and

(d) you have complied with these Terms and have not engaged in any fraudulent, abusive, or otherwise inappropriate conduct in connection with the Programme.

3.2 The value and type of Voucher will be as specified in the relevant promotional materials displayed by Lendable at the time of your application.

4. ISSUE OF THE VOUCHER

4.1 Subject to clause 3, the Voucher will be issued within thirty (30) days after the expiry of the Withdrawal Period.

4.2 The Voucher will be sent by Lendable to the email address we have registered for you. It is your responsibility to ensure that your registered email address is accurate and up to date.

4.3 Unless expressly stated otherwise in the relevant promotional materials:

(a) the Voucher is non-transferable;

(b) there is no cash alternative to the Voucher; and

(c) Lendable reserves the right to substitute the Voucher with an alternative of equal or greater value where reasonably necessary.

5. DATA PROTECTION AND PRIVACY

5.1 Lendable may share personal data relating to the Programme with third-party service providers who assist in administering the Programme and issuing the Voucher, subject to appropriate data protection safeguards.

6. MARKETING AND COMMUNICATIONS

6.1. By participating in the Programme, you agree that Lendable may contact you by email, SMS, or other electronic means in connection with the Programme, including to:

(a) provide information relating to your eligibility;

(b) update you on the status of your Voucher; and

(c) provide information about updates or changes to the Programme.

7. VARIATION AND TERMINATION OF THE PROGRAMME

7.1. Lendable reserves the right to amend, suspend, or terminate the Programme at any time, in its sole discretion, with or without notice.

7.2. Lendable may, in its sole discretion, refuse to issue a Voucher or terminate an individual’s participation in the Programme if that individual:

(a) ceases to meet the eligibility criteria;

(b) breaches these Terms;

(c) engages in fraudulent or abusive conduct; or

(d) for any other reason that Lendable considers appropriate.

8. GENERAL TERMS

8.1. Liability: To the fullest extent permitted by law, Lendable’s total liability arising out of or in connection with the Programme, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the value of the Voucher (if any) to which you are entitled under these Terms.

8.2. Waiver: No failure or delay by Lendable in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy.

8.3. Entire Agreement: These Terms, together with Lendable’s privacy policy and any other documents expressly referred to herein, constitute the entire agreement between the parties in relation to the Programme and supersede all previous agreements, understandings, and arrangements between the parties in respect of the Programme.

8.4. Governing Law and Jurisdiction: These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or their subject matter.
