Law 14.754/2023, effective January 1, 2024, introduced key updates for individuals with investments abroad:
Annual taxation of dividends and capital gains at a fixed 15% rate.
Elimination of monthly Carnê-Leão and GCAP obligations for this asset class.
Losses can be offset against gains in future years.
No exemption for transactions under R$ 35,000/month.
Taxes already paid abroad may be used as a tax credit in Brazil (up to 15%).
Important: these changes apply only to foreign financial assets. Other income sources such as rent, salaries, or pensions remain under the Carnê-Leão regime.
