What should I do if I think the other driver was uninsured or drunk?

For Marshmallow policyholders involved in an accident with someone who may not be insured or may have been under the influence of alcohol.

What are the signs?

You might suspect the other driver is uninsured or drunk if:

  • They refuse to share insurance details

  • They appear confused, aggressive, or impaired

  • They attempt to leave quickly

  • Their vehicle has no number plate or MOT disc (if visible)


What should I do at the scene?

  1. Call 999 immediately if someone appears to be under the influence or if there’s a risk to safety.

  2. Call 101 if it’s not an emergency but you suspect illegal driving (e.g. no insurance).

  3. Take note of:

    • Their registration number

    • Make/model of their vehicle

    • Time and location

    • Their behaviour and any comments made

  4. Do not confront them – Your safety comes first.

  5. Ask witnesses for contact details if possible.


What information should I give Marshmallow?

  • That you suspect the other driver was uninsured or under the influence

  • The crime reference number from the police

  • Any photos or witness statements

Report your claim within 48 hours by calling 0800 060 8622.


What happens next?

We’ll investigate your claim. If it’s found the other driver was uninsured and you were not at fault:

  • Your No Claims Discount will not be affected

  • We’ll refund your excess

If the other driver is later found to be under the influence, this won’t affect your claim, as long as you reported everything as soon as possible.
