How do I claim for personal injury after a car accident?

Marshmallow policyholders who were injured while driving or travelling in their insured vehicle.

If you’re injured in a car accident, your Marshmallow policy may help cover medical expenses or provide financial support. The type of support depends on who caused the accident and the level of cover you hold.


If the accident wasn’t your fault

You may be able to claim compensation through your Motor Legal Protection (MLP) cover, if it’s included in your policy. The cover is provided through our partners at Winns Solicitors.

MLP can help cover:

  • Legal costs up to £100,000 to claim compensation for your injury, lost earnings, or damaged belongings.

  • Up to £50,000 for vehicle hire, repair, or storage charges.

  • Defence costs up to £100,000 if you’re accused of a motoring offence.

Important: MLP only applies to non-fault accidents and when there’s a 50%+ chance of success.


If the accident was your fault

You can’t claim injury compensation through MLP in this case, but you may still receive a personal accident payout, depending on your plan.

This benefit only applies if the injury happened while getting in, out of, or travelling in the insured vehicle.


Can I claim medical expenses?

Yes. If included in your cover, we can pay up to £200 per person for medical expenses such as physiotherapy or private treatment following a valid claim.
