Can my passengers claim compensation if they’re injured in my car?

If your passengers are injured in an accident involving your car, there are a few ways they can make a compensation claim. What happens next depends on who was at fault.


If the accident wasn’t your fault

Passengers may be able to claim compensation from the third party responsible. They can do this by:

  • Using the Official Injury Claim (OIC) portal, or

  • Having Winn Solicitors handle their claim (if you have Motor Legal Protection and it applies).

Note: Motor Legal Protection only supports the policyholder’s claim, not their passengers’. However, we’ll advise them on next steps.


If the accident was your fault

Passengers can still claim for their injuries — but they will need to go through a different process. In this case, we recommend they:

  • Contact their own insurer or legal representative, or

  • Use the OIC portal to make a personal injury claim.


Can passengers use my policy for compensation?

No. Your personal injury or Motor Legal Protection cover applies only to you (the policyholder) and, in some cases, your spouse. Your passengers will need to claim separately.
