Who can be a Healthcare Agent?

In most states anyone 18 years of age or older can serve as a Healthcare Agent. Generally, an attending physician or other healthcare provider cannot serve as your Healthcare Agent. In other words, if your doctor is treating you for a condition or if you are in a nursing home facility, you should not name your doctor or any employee of the nursing home facility as your Healthcare Agent.
