At NextSense, we’re passionate about mental privacy. We’ll never sell, share, or use your data without your explicit consent. We promise to protect your biological information through ethical principles and technological safeguards. Here’s how:

You own your brain data. Your brain data belongs to you, and you control how it's used. You can view and delete your data anytime.

Data sharing is off by default. We never collect data without your explicit consent.

Data minimization. We collect only essential data to deliver an optimized experience.

This Privacy Policy explains how NextSense, Inc. (“NextSense,” “we,” “us,” or “our”) collects, uses, and protects your personal information when you use our SmartBuds, the NextSense app, visit www.nextsese.io (the “Site”), or otherwise engage with our services (collectively, the “Services”). “You” refers to any user of our Services, including customers, app users, and site visitors.

By using our Services, you agree to the terms of this Privacy Policy. If you do not agree, please do not access or use the Services.

1. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal obligations.

  • If we make material changes (for example, expanding the types of data we collect or how we use it), we will notify you through the app, website, or email—before the changes take effect.

  • If the changes affect your consent, we will ask you to review and re-confirm your consent.

  • Minor updates (like clarifying language or formatting) will not necessarily trigger a new request for consent.

The “Effective Date” at the top of this page indicates when the latest version went into effect.

2. Data We Collect

The data we collect depends on how you interact with our Services. We follow a principle of data minimization and collect only what’s necessary to deliver a high-quality experience.

a. Information You Provide Directly

  • Contact Information: Name, email, address, and phone number.

  • Order Information: Billing/shipping address and order history.

  • Account Information: Username, password, and security questions.

  • Customer Support: Information shared in messages or requests to our team.

b. Sensor and Sleep Data from SmartBuds

  • EEG (brainwave) Data

  • Motion Data

  • Sleep Metrics (e.g., sleep duration, sleep stages)

c. Usage Data

We collect information about how you use the SmartBuds, the NextSense app, and the Site, including:

  • Session frequency and duration

  • Feature usage

  • Device type and technical interactions

d. Information from Third Parties

We may receive limited personal information from service providers (e.g., payment processors, fulfillment vendors, or analytics tools) when needed to operate the Services.

3. How We Use Your Data

We use your data for the following purposes:

  • To Provide and Improve Services: Deliver personalized features, optimize sleep and focus algorithms, and respond to support requests.

  • Product and Brand Development: Use aggregated, anonymized data to improve product design and messaging.

  • Account Management: Process purchases, maintain accounts, and provide order-related notifications.

  • Legal and Security Obligations: Comply with applicable laws and protect against fraud or misuse of the Services.

4. Data Sharing and Disclosure

NextSense does not sell your personal data.

We do not share your identifiable personal data with third parties unless:

  • You explicitly opt in (e.g., to participate in a research study or integration)

  • We’re working with service providers who help operate our Services under strict confidentiality obligations (e.g., shipping, customer support, data storage)

  • We’re complying with legal requirements, enforcing our terms, or protecting our users

  • The data is aggregated and anonymized (and cannot identify you)

5. Cookies and Tracking Technologies

We may use limited tracking technologies (e.g., session cookies) to support site functionality, ensure secure checkout, and monitor basic performance metrics. We do not currently use third-party marketing cookies, but we may revise this policy if that changes.

6. Data Storage

Your personal data is processed and stored on secure servers. While we take steps to safeguard your data, no system is entirely immune to risk. We recommend using strong passwords and protecting your device to help keep your data secure.

7. Your Privacy Rights

You have the following rights:

  • Right to Know: Request what categories of personal data we collect.

  • Right to Access & Correction: Review and correct your personal information.

  • Right to Delete: Request deletion of your personal data, with certain exceptions.

  • Right to Opt Out: Decline data sharing (we don’t sell data).

  • Right to Withdraw Consent: Stop participating in data collection at any time.

You can exercise these rights by contacting us at support@nextsense.io. We may need to verify your identity to process your request. NextSense will respond to requests as promptly as possible, and always within 2 weeks.

8. Children's Data

The Services are not intended for children under the age of 13, and we do not knowingly collect data from children. If you believe a child has submitted personal information to us, please contact us so we can remove it.

9. International Users

If you are located outside the United States, please note that your data may be transferred to, stored, and processed in the U.S. or other countries. We take appropriate steps to ensure adequate protection in line with applicable data protection laws.
