New Texas law impacts SMS to fans starting September 1, 2025

Beginning September 1, 2025, Texas introduced stricter rules for sending marketing SMS to residents. If you’re not registered with the state, texting Texas numbers can carry significant penalties.

To protect you, Openstage is restricting your ability to send SMS to fans with Texas phone numbers who opt in after September 1, 2025. This ensures you stay compliant and avoid risk under the new law.

Here’s what this means:

  • You can still collect phone numbers from Texas fans (sign-ups work normally).

  • You can continue texting Texas fans who gave consent before Sept 1, 2025.

  • You cannot text Texas fans who consent on or after Sept 1, 2025 (unless you're registered).

  • You must follow Quiet Hours requirements for Texas fans:

    • No marketing texts before 9 a.m. or after 9 p.m. CT Mon–Sat

    • No marketing texts before noon or after 9 p.m. on Sundays

  • Opt-out enforcement will be handled automatically by Openstage.


How to restore full SMS to Texas fans:

  1. Register with the Texas Secretary of State → Fill out form 3401

  2. Pay the $200 annual registration fee

  3. Post a $10,000 security deposit (or secure a surety bond for a smaller annual premium)

  4. Submit proof of registration and complete Openstage’s compliance form →

Once verified, we’ll re-enable SMS for new Texas fans on your account.
