These terms of use apply to the use of the platform www.parknsleep.app and constitute a legally binding contract between the user (host, camper) and parknsleep AG (hereinafter "Parkn'Sleep"), which governs the use of the websites and applications and other offers of this platform.

These terms of use apply to all contracts concluded between you as a user and us as the operator of the platform.

The parknsleep AG is a Lucerne start-up that found its beginning in autumn 2019 and was founded in January 2021. Through intensive market analysis and workshops with authorities and decision makers, after about 18 months we have developed a product that reflects modern RV tourism. Our mission is to promote RV tourism in the tourist destination regions of Europe and to involve tourist destinations at the same time. Through the platform we provide the technical possibility to integrate all market participants in a fair way and to actively promote tourism and in particular to make the management of RV parks attractive and safe.

Parkn'Sleep or the parknsleep.app is an intermediary platform for RV sites with parking characteristics. It differs fundamentally from reservation platforms for camping offers.

Providers, so-called hosts, advertise their parking space on the platform. Unlike campsites or reservation platforms, Parkn'Sleep pitches cannot be reserved in advance. They can be approached spontaneously at any time.

With our system, the availability of available individual pitches is displayed on the respective pitch advertisement. Available pitches are marked on the map search with a green pin, scarce pitches with a yellow pin and fully booked pitches with a red pin. The booking takes place only on site by the "check-in" confirmation. Availability is not binding and is considered a forecast. Nevertheless, the availability of the places is to be ensured by the host to the best of his knowledge and belief. Parkn'Sleep does not guarantee inaccessible, unavailable pitches and generally incorrect information provided by the host.

Pitch offers can be posted by municipalities, private individuals or legal entities. The hosts as well as the advertised pitches must comply with the relevant general conditions.

The web app www.parknsleep.app is free of charge and can be used to search for official pitches. Advertised parking spaces can be accessed with the intention of booking at any time and without registration. Registration (name, first name, vehicle registration number and payment details) is only necessary immediately before the first booking (check-in). Payment data is transmitted in encrypted form and is not stored locally. Personal details remain stored in the customer account. For the rest, our privacy policy (insert link) applies.

The booking is made during the check-in process. Once the camper has arrived at a Parkn'Sleep site, he can secure a single site by checking in his vehicle accordingly with a swipe motion and confirming the booking.

Payment is automatically made to the appropriate parties at the time of booking. The host receives the accommodation fee and the municipality, if agreed, the tourist tax.

If a camper is not aware of Parkn'Sleep upon arrival, they can start the process by QR scanning the check-in point on site.

Campers do not pay a service fee with us, unlike many reservation platforms. The overnight fee is displayed as a total amount in the pitch advertisement. Any visitor's tax is shown separately under the total amount.

Hosts are municipalities, private individuals or legal entities that provide pitches to campers on the platform. They meet the appropriate conditions to be able to advertise a pitch on Parkn'Sleep. Also the advertised parking space fulfills the appropriate basic conditions.

Pitches can be advertised free of charge on the platform www.parknsleep.app. There is no contractual connection, fixed fees or running times. A deactivation or pausing of the advertisement is at any time possible. The service provision takes place between host and camper.

Parkn'Sleep charges a platform fee of 15% on the overnight price paid by the camper. Consisting of payment processing fee (payment infrastructure, payout managment, debt risks etc.) and service fee (support, platform service, marketing, product development etc.).

Example: The posted overnight price is CHF 20.00 The total price displayed to the camper is CHF 20.00. Parkn'Sleep receives CHF 3.00 platform fee and the host receives CHF 17.00 credited to his payout account.

Parkn'Sleep offers exclusive cooperations for partners. Information can be requested at hello@parknsleep.app.

Tourism levies can be claimed by the relevant organisations. The settlement is done automatically via Parkn'Sleep. The guest (camper) indicates the number of persons in the vehicle at check-in. The overnight stays are added to the total price.

Example: The municipality XY charges CHF 1.50 for one overnight stay. The host's set overnight price for a place in this municipality is CHF 20.00 Mr. and Mrs. Müller do the check-in and indicate 2 persons. The total price shown to the camper is therefore CHF 23.00 Parkn'Sleep receives CHF 3.00 platform fee from this, the municipality CHF 3.00 tourism tax and the host CHF 17.00 on his payout account.

Parkn'Sleep can be implemented free of charge as a payment system for existing RV parks. Providers can simply register as hosts and record their space. A use as a second system, e.g. to existing parking meters, parking management systems, directories or reservation platforms is possible at any time and without additional effort.

You are responsible for your own acts and omissions, and also for the acts and omissions of anyone you invite to join, or to whom you give access to, the booking of a camper pitch. This means, for example, the following: (i) you are responsible for leaving a pitch (and related personal property) in the condition in which you found them, and (ii) you must always act with integrity, treat others with respect, and comply with applicable laws. If you are booking for an additional guest who is a minor, or if a minor is accompanying you, you must be legally authorized to act on behalf of the minor, and you alone are responsible for the supervision of that minor.

The Check-In Point signals the pitch to arriving campers. Each host receives a welcome set free of charge. This includes a sign (A5). The Check-In Points are equipped with an individual QR code. A scan leads directly to the check-in area of the corresponding pitch.

The Check-In Points will be sent as soon as a new pitch is registered and it has been checked and approved by us.

Special and larger signage will be discussed individually with the hosts and produced by us.

The contractual relationship (incl. rental contract) arises between host and camper for the purpose of using the pitch advertised by the host. Parknsleep AG is only an intermediary and not a party to the rental contract.

Through the confirmation of the booking (check-in) by the camper, the rental contract comes into effect automatically and without renewed consent of the host.

The contractual relationship includes the conditions and services listed in the advertisement at the time of booking. When you confirm a booking request or receive a booking confirmation, you enter into a contract directly with the camper and are responsible for providing the service under the conditions and at the price indicated in your listing. In addition, you are responsible for paying all applicable fees (and applicable taxes) for each booking. Any terms or conditions that you include in any supplemental agreement with guests must: (i) be consistent with these Terms of Use, our policies and the information provided in your Listing; and (ii) be clearly stated in your Listing description.

The contractual relationship ends with the termination of the booking (Check-Out process).

Parkn'Sleep has a host referral program where users (campers and hosts) can refer new hosts and earn money. See the terms of use for the host referral program.

You must follow these rules and not help or entice others to break or circumvent them. The following applies:

All rights and obligations arising from the contractual relationship for the use of pitches arise exclusively between the host and the camper. Hosts provide the offered services to the camper exclusively on their own responsibility. Exclusively campers are liable to the hosts for the contractual use of the pitch.

Parknsleep AG rejects any liability and warranty for claims resulting from the rental contract.

In all other respects Parkn'Sleep is liable according to the legal regulations for intent and gross negligence. The same applies to the assumption of guarantees or any other strict liability or in case of culpable injury to life, body or health. In case of slightly negligent breaches of essential contractual obligations by us, the liability is limited to the typically occurring foreseeable damage.

Any further liability of Parkn'Sleep is excluded.

If you believe that a user, listing or its content poses an immediate risk to a person or pitch, contact local authorities immediately before contacting Parkn'Sleep. In addition, if you believe that a member, listing or content violates our standards, you should report your concerns to Parkn'Sleep. If you have reported a concern to local authorities, Parkn'Sleep may request a copy of that report.

The contract between you and Parkn'Sleep reflected in these Terms of Use will remain in effect until either you or we terminate the contract in accordance with these Terms of Use.

You may terminate this Agreement at any time by sending us an email requesting that we delete your User Account. Parkn'Sleep may terminate this Agreement at any time upon 30 days' notice by email or by using any other contact information you have provided for your User Account.

Parknsleep may also terminate this Agreement without notice and cease providing access to the Platform if you materially breach any of your obligations under these Terms of Use or our policies, or you violate any applicable law.

Vouchers and credits can be purchased on the Parkn'Sleep website and are redeemable exclusively for overnight stays on Parkn'Sleep pitches. After purchase, they can be used as a means of payment.

The responsibility for the vouchers and credits lies with the owner. They cannot be refunded, returned or paid out in cash. The balance can be used for full or final payments. Cash payment of the remaining balance is not possible.

According to Swiss law, a voucher or a credit balance remains valid for 10 years. If a voucher or credit is not used within this period, the credit expires.

These Terms of Use are governed by Swiss law. If you are a consumer and mandatory consumer protection laws in your country of residence contain more favorable provisions for you, these provisions apply regardless of the choice of Swiss law. As a consumer, you may bring claims in connection with these Terms of Use both before the competent court at your place of residence and before the competent court at Parkn'Sleep's registered office in Switzerland. If Parkn'Sleep wishes to enforce its rights against you as a consumer, we can only do so in the competent courts at your place of residence. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the Swiss courts at Parkn'Sleep's place of business.
