Term

Person

Includes a natural person and company

Presumed Income

  1. Revenue which has accrued to a person during a year of assessment but which has not been received by him in such year shall not be included in the calculation of presumed income for that year of assessment until such time as he shall have received such revenue; provided that, for the purposes of this paragraph, revenue which has either been made available to the person to whom it has accrued or has been dealt with on his behalf or according to his directions shall be deemed to have been received by such person; and

  2. Revenue accrues to a person for purposes of calculating presumed income when he becomes entitled to claim payment thereof;

Year of Assessment

The period of 12 months commencing on 1st January in any year.

Control

  1. By means of the holding of shares or the possession of voting power in or in relation to that or any other company; or

  2. By virtue of any powers conferred by the articles of association or other document regulating that or any other company, that the affairs of the first-mentioned company are conducted in accordance with the wishes of that person.
