State regulations regarding hemp products and where we can ship!

We are able to create our products and ship them out to you per the 2018 Farm Bill. This bill allowed the federal legalization of hemp derived products in all 50 states, the District of Columbia, the Virgin Islands, and Puerto Rico, so long as they contain 0.3% or less of D9 THC by dry weight. To remain compliant with these laws, all of our products (gummies, edibles, tincture oil, flower, and vapes) are directly derived from the hemp plant, and contain <0.3% D9 THC by dry weight. We do not ship outside of the United States or U.S. Territories.

While the Farm Bill still stands, due to ever-changing restrictions, certain states and counties may have differing standards regarding hemp legality. Below is a detailed guide that we update regularly, providing information on basic state hemp laws. At this time, many states are creating stricter regulations on hemp products, so you may find that some products are inaccessible in your area.

Most recent regulations pertain to THCa, high potency D9 THC, and synthetically derived cannabinoids like Delta 8 THC or THCP. Some states have generic D8 and THCa agriculture or health ordinances banning the cannabinoids; other states have bills passed into law, rather than ordinances for regulation.

Alabama*

AL passed into legislation HB 445, stating that as of July 1st 2025, in state purchase / possession of any vapes, flower, or smokable products are restricted. Hemp derived gummies with a 10mg THC limit per dose and 40mg THC per container will be legal.

The state allows THCa flower so long as it follows the 2018 Farm Bill regulations, maintaining a 0.3% THC limit by dry weight. State laws upheld in Act 629 do hold stricter regulations regarding all hemp and THC products, which should be reviewed by the consumer prior to purchase.

As of June 2025, Delta 8, Delta 10, and other generally synthetically derived cannabinoids were declared illegal to purchase within the state. THC-O is illegal as well.

Georgia*

GA has issued regulations in SB-220 banning more than 30 pieces per container, and a limit of 10mg of D9 THC per individual gummy serving.

Additionally, SB 494 passed in 2024, keeps hemp under 0.3% THC legal for adults 21+ with strict rules (OCGA §2-23-4), while banning edibles/baked goods, THCa flower/vapes, and THCa products above the 0.3% level. (OCGA §2-23-3.1)

Florida*

Florida has passed HB1409, providing stricter, more regulated guidelines on THC purchases.

THC Products are legal for purchase in the state, with certified lab testing requirements, child resistant packaging requirements, and a 21+ age restrictions on hemp products.

Idaho*

The state of Idaho has strict hemp laws across the board through HB-126.

Hemp derived products have been banned from being purchased and farmed within the state. All farmers/growers/consumers must abide by ISDA guidelines. Only broad-spectrum (THC Free) CBD products are allotted.

Other derivatives of CBD containing traces of THC, such as Full Spectrum CBD, are strictly prohibited in Idaho.

Iowa*

As of July 2024, passed in HF 2605, Iowa banned synthetic cannabinoid products such as Delta 8, Delta 10, and THCP.

The law states that only products containing 0.3% or less D9 THC by dry weight, in accordance with the 2018 Farm Bill, may be permitted.

Consumable hemp derived products may not exceed 4mg of total THC per serving, or 10mg THC per package.

All smokeable (flower and vape) products derived from synthetic cannabinoids or THCa, are strictly prohibited per Iowa law.

Kansas*

Per 2026 guidelines under Kan. Stat. Ann. § 2-3901, which factors in THCA at a 0.877 conversion rate, states THCA is legal in Kansas only if products test at or below 0.3% total THC.

Vapes, flower, and cigarettes are banned for purchase in Kansas. Only edibles, tinctures, topicals, and capsules meeting total THC limits are permitted for purchase.

Kentucky*

THC and hemp products are legal in Kentucky, but must be properly licensed. State regulations also require lab testing and specific label requirements.

Louisiana*

THC and hemp products are legal in Louisiana, with a dosage cap at ≤8mg total THC per serving. All THC products must be registered, and have an age requirement of 21+.

Delta 8 smokeable products are not legal for purchase in the state. Only D8 edibles and gummies are permitted, within state limits.

Mississippi*

In 2025, the state passed HB 1502. This bill bans the sale of most intoxicating hemp products, including Delta 8 and high potency THC, but allows for low potency products with a proper CBD - THC ratio to be purchased.

THCa smokeable products are not permitted for retail purchase, and may only be obtained through the state run licensed medical cannabis program.

New Hampshire*

The sale of hemp/THC products exceeding 0.3% THC by dry weight is prohibited, per RSA 439-A:4, in line with the 2018 Farm Bill. However, this law extends to and considers high potency THCa products that convert into D9 THC after decarboxylation, strictly regulated. Delta 8 THC is not permitted for sale in the state.

Only low potency THC products may be purchased in a retail setting. High potency THC and THCa smokeable products may be purchased through medical dispensaries licensed with the state cannabis program.

New Jersey*:

Marijuana and THC are legal in New Jersey for adults 21 and older through the state’s regulated cannabis system. As of April 13th, 2026, NJ Law P.L. 2026, c.7, states that hemp is legal only in non‑intoxicating forms, with all products subject to strict limits, age requirements and oversight. The following cannabinoids/products are banned from being purchased/shipped to New Jersey:

  • Any hemp plant or seed exceeding 0.3% total THC (including THCA and other THC variants)

  • Any finished product containing more than 0.4 milligrams of total THC per container

  • Any hemp‑derived product made with chemically synthesized or converted cannabinoids such as Delta‑8, Delta‑10, or THCP

THC / Hemp products are legal for sale and purchase in the state. There are efforts to pass bans and stricter regulations, but none have passed at this time.

While that may be the case, certain cannabinoids are strictly monitored and regulated in the state. This would include Delta 8 THC, and THCa - allowances of these vary by county, and most regulations label these as a controlled substance.

Tennessee*

Beginning in January 2026, TN banned the availability of THCa, and other HDCP (hemp derived cannabinoid products) in HB-1376. Only edibles, gummies, and beverages containing 0.3% or less Delta-9 remain legal for in-state purchases.

These products are strictly monitored and sales are approved only for T-ABC registered businesses.

Direct-to-consumer shipping of hemp-derived cannabinoids to Tennessee addresses is prohibited

Effective July 1st, 2026, The Hemp Doctor is no longer able to ship products into the state of Tennessee.

Texas*

The Hemp Doctor products (gummies, edibles, beverages) compliant with the 2018 Farm Bill are eligible to be shipped to TX.

As of March 31st, 2026, the state of Texas has banned the sale of smokeable hemp products (flower and vapes).

As of July 31st, 2026 Delta 8, Delta 10, THCP, THCa are banned for sale in the state.

Only Delta 9 THC edibles, gummies, and beverages within the 0.3% legal limit are legal in the state of Texas.

Virginia*

In June 2026, Virginia passed HB 30, stating the following:

As of August 15th, 2026, Virginia has declared that a hemp product may not exceed 0.3 percent total THC and may not have more than two milligrams of total THC per package. The previous standard of a 25:1 CBD to THC ratio will no longer stand, and Delta 8 will not be available for purchase.

All smokeable and edible hemp products within legal regulations must be properly licensed, and sold in child resistant packaging.

West Virginia*

In 2023, SB 220 and 546 were signed into law. These bills declare certain hemp-derived derivatives, isomers, and cannabinoids with a THC content of 0.3% or less are legal. Hemp derivatives or extracts can be infused into cosmetics and edibles and sold in the state. All hemp-derived products sold in West Virginia must be registered with the WVDA.

Alternative cannabinoids such as Delta 8 and Delta 10 THC are prohibited for purchase in the state.
